Judge rules in favor of alleged spammer
A New York state judge has granted a preliminary injunction against PaeTec Communications, preventing the Internet service provider from giving alleged spammer MonsterHut the boot from its network. In effect, the order continues a temporary restraining order issued in April, allowing MonsterHut to send commercial e-mail over PaeTec's high-speed Internet pipes. The judge ordered the injunction because there was some question about the exact nature of agreement between PaeTec and MonsterHut, among other issues, according to one of PaeTec's attorneys. The injunction will remain in place pending trial, which is expected sometime after mid-September.
