Short Take: Novell wins round in piracy case
Novell won a round in its piracy suit against Salt Lake City company Hammond Computer, doing business under the name of Network Centre, when the U.S. Bankruptcy Court appointed a trustee to oversee Hammond's business affairs. Novell had claimed Network Centre had abused Novell's upgrade policies and breached its contract with Novell by not paying royalties and other obligations to the tune of almost $9 million. Novell had already won a Fourth District Court decision to recover $5 million in Novell products; the district court also barred Network Centre from further sale of Novell serialized products. The case was moved to bankruptcy court when Network Centre declared bankruptcy.
