U.S. District Judge Donald Middlebrooks has dismissed several portions of Comcast's lawsuit against Broward County, Fla. Comcast sued Broward County, seeking to overturn a new "open access" provision, after local officials voted to require non-discriminatory access for ISPs to Comcast's high-speed cable modem Internet system. Open access supporters the OpenNet Coalition cheered the decision while Comcast representatives said the cable operator plans to pursue the case on First Amendment grounds, which were not thrown out by the judge.
