Telstra, an Australian telecommunications carrier, filed a legal action in the United States to require the FCC to review an August order, which adopted "benchmarks" limiting the settlement payments made by American carriers to foreign carriers for handling international telephone traffic. Telstra argues that the FCC failed to consider the above-cost fees that U.S. carriers charge foreign carriers for international capacity needed to service Internet traffic.
