Short: AOL resumes email blocking

The Third U.S. Circuit Court of Appeals today overturned a lower court's preliminary injunction against America Online. AOL can now resume blocking Cyber Promotions junk email sent to AOL customers. According to the Bloomberg news service, District Judge Charles Weiner had erred by not holding a fact-finding hearing prior to issuing the injunction. Cyber Promotions filed a suit against AOL in March accusing the online service of trying to put it out of business.
