Since she did bootleg an amount that would not be considered "fair play" and also that there are explicit EULA's that, by purchasing her ticket, she agreed to - I think the movie theater is on the right side here.

a few thoughts, though:

1) 2 nights in jail seem a bit harsh. 1 night may have had the message "hit home".

2) There have gotta be better methods than time in the local jail to "get the message home" for an offense like this.

3) In India, the theaters and/or movie producer will pay someone to watch over the reels of film - night and day. This so that no one smuggles a the set of reels away and thus jeapordizes the producer's ability to recoup the cost of the making the movie via its presentation.

And frankly an absurd overreach by the cinema. If I'm paying for it to reach my eyes I should be entitled to record my own copy too. It only should become any concern of theirs if I start mass distribution of the copy. Via say torrent.

Bull crap. You aren't entitled to anything beyond sitting there and watching the movie. Honestly, this entitlement mentality has gone way too far.

...don't buy the ticket. It isn't YOUR theater seat, it is theirs, and they are letting you sit in it for a fee. They can make whatever requirements they want to go along with the ticket that you purchased of your own free will. This isn't a public place where you were just walking along and saw something you wanted to video. This is private property, and they can have whatever rules they want governing your behavior on their property.

It doesn't hurt the cinema in any way and is absurdly and stupidly restrictive. The real issue is mass file sharing of recordings, not the recordings themselves. It's the same type of thinking that makes people say bit torrent is evil.

Dear Buzz Crew and Gang,
I happened to know a little information about these types of issues. For those that do not know, here is the short lists of facts:

1. Theater Owners and Companies make very little money on movies.

2. Theater Owners have been fighting with the movie production industry for years over movie distribution, ticket costs, and movie release windows for films. This means shrinking dollars for theaters.

3. Theater Owners are paid a bounty for every individual they turn over to the police for recording a portion of a film. There is some precedence for this activity.

Bottomline: Just do not use a recording device in a theater....period. It is not worth the hassles if you are caught.
