Skype is owned by Microsoft so to update the app, Microsoft and Samsung would have to make it happen.
Then there are issues in making this happen beyond the court room. Money being one of them. Since the TV's sale has come and gone there's no recurring revenue to pay for the project.
As to your last question about upgrading the app. No. Samsung for almost all models does not allow everyone to issue apps. Here's a picture of the process I snapped at a developer's meeting.

I believe it's a caching issue, Everytime, guarantee, Skype will drop a video call anywhere from 14min to 55min. I have a Samsung SmartTV (model UN50H5500). Skype comes pre-installed, and I've tried to remove and update. But the Version still shows 3.0. This could be that Samsung refuses to update 2014 models. Is it possible to upgrade this app another way other then from samsung? Skype is no help either.
