1. Return as defective. Get a refund get something else.
2. Small claims court if step 1 doesn't work.
You should find NO remuneration for loss of use. Don't even try.
I purchased a samsung galaxy s9+ phone on July 27. I traded my earlied s8 for this phone by paying the difference. The phone was defective from beginning and took blurry images as camera was not able to focus. I had planned a vacation and I went to London and India on 3rd August. I was not able to take pictures as they were coming out blurry. So samsung ruined my $ 15000 vacation. I made a request for return of the device from London
but they gave me only 15 days time to return the device, but since I was out of US I could not return the same. When I came back to US on 27th August and called customer care, they checked the device remotely and asked me to take the device to Ubreakifix location. i did that and they concluded that the device had manufacturing defect. So i called again Samsung and they told me to send the device for repair. I send the device and received the same back in 10 days. They said that they repaired the same, but the problem was same. So I called again to Samsung and they asked me to send the device again. I did that again and received the device in 10 days with same problem. When I called again and asked them that Its too much and I don't want to use the defective samsung phone, I requested a refund but they said they do not ever refund for a phone which has manufacturing defect even if they are not able to repair it. So i requested for repalcement and they said that they will forward my request to evaluation team. And Now I have received a mail from samsung that they do not exchange their faulty phones and if i want my phone repaired I have to contact samsung for repair only.
It is not a good gesture that in United states a company is selling phones without checking for defects, and if it has defect they ask to send the phone and they return the same with existing problem not once but twice and say that we will not exchange our defective phones, if you want your can contact us for repair only.
I would like to know from anyone, what actions I can take against the company so that they do not cheat other people like me.
