Series 5 40" (LA40A550) - HDMI black level issues

My PS3 is connected to my LCD Series 5 through HDMI and I have a problem with the HDMI black level settings.

When I change the HDMI black level settings everything is fine. My problem starts when I turn off and on my television (still on the PS3 source), although the HDMI black level shows that it's on Low settings, it's actually showing Normal brightness settings - I'll have to re-input the settings by scrolling to Normal and back to Low for the LCD TV to output Low HDMI levels.

This just gets really annoying because everytime I start up my TV I have to manually change the settings to get Low black levels, is this a Samsung software issue within the TV set?

Any help would be appreciated.
