Is it the smudge at the top...

Check the lens and look for something on the glass.

Gently blow your breath onto the glass to add moisture and then wipe the glass with a clean soft cotton cloth. (an old handkerchief is good).

If there is no smudge on the glass, you may have dust on the sensor, or inside the lens.
You can not fix that.

If you cannot cure the problem by cleaning the lens, take the camera back for a replacement or a refund.

I tried the above. It is still there. I guess I will just take it back and get a new one!
