Refurb Desktop arrived with different OS

My newly purchased refurb Studio XPS 435MT OS was listed as having Vista Home Premium. OK for my purposes, would not have been my first choice.

To my surprise, when it arrived, it had Vista Ultimate instead. The additional features of Ultimate much more to my liking.

However when I went online to register for the free Windows 7 upgrade and entered my service tag, the system identifier showed my OS as Home Premium French language edition! And sure enough, my system restore disc is for Home Premium! So if I take advantage of the free upgrade, I will end up with an inferior OS version in the wrong language!

Two hours of phone calls to customer support and xps tech support
have produced no results, the customer support person's suggestion of deleting and re-registering accomplished nothing.

Anyone encounter this before? I know for certain that Dell Outlet systems can arrive with a different OS as it happened when I purchased an XPS M1330 three years ago, with an XP Pro downgrade and it arrived with Vista Ultimate instead. How do I get Dell to recognize the current OS and provide me with the corresonding restore disc and same level of Windows 7 upgrade?
