why cant they just pay licensing fee? like "zipper"

i mean i think something as basic as multitouch shouldnt be patent-able, but if it is, like some common things we use every day and dont realize that they use licensed patented technology, then why not just license it?

also, is apple suing microsoft for its surface? or John King/CNN for the big board?
