You should be able to transfer the files without having the program available. That's the same as transferring an mp3-file you downloaded without having a program to make mp3's. It just are files on your hard disk that you can copy to everywhere you like.
Assuming these files are important enough for you to backup and the backup program you used you might be able to get them from your backup also.
Not having a backup implies you didn't mind to lose them. So why mind about copying them then?

Have an old XP home pc which has been playing up since moving late January 2012 which I have replaced with new win7 pc however have some home records which I cannot either transfer [program based] or port [system troubles] to the new machine.
In particular have Filesphere Pro 2006 a records management program which does not open and seems to also house, apart from all the digital home business records, the pc ills.
Some of my include:
1. Windows 32 services error
2. Print spoolers error
3. Spooler subsystem error
4. Microsoft SQL error
5. Programs for Filesphere [records management] are not opening & a possible MSDE 2000 error has been identified by their help desk.
7. AVG message appears on opening Outlook even though I uninstalled AVG 12 months ago
and I cannot seem to do anything about it.
8. Tried to look at windows firewall however message stating the Windows cannot start firewall internet connection {ICS] service returned; should I be concerned about this.
`PC data
9. windows update service is also not starting either auto or manual.
Windows XP
home edition
Version 2002
SP 3
How do I go about fixing these problems?
Am already resigned to the need to purchase newer Filesphere version for the new Win7 pc I now have but think I need to do something about the older vers. to enable me to port the file contents;
Am I correct?
