I am 17, almost 18 and I am having questions about the legality of two certain laws in MA. I find that the two laws is really confusing and moreover it is contradictory. If anyone is a lawyer, or knows anything about this or even just has an opinion please feel free to shoot an answer. Ok here are the two laws in question:

*********[Chapter 272: Section 4. Inducing person under eighteen to have sexual intercourse
Section 4. Whoever induces any person under 18 years of age of chaste life to have unlawful sexual intercourse shall be punished by imprisonment in the state prison for not more than three years or in a jail or house of correction for not more than two and one-half years or by a fine of not more than $1,000 or by both such fine and imprisonment.

Chapter 265: Section 23. Rape and abuse of child
Text of section as amended by 2008, 205, Sec. 2 effective October 22, 2008. For text effective until October 22, 2008, see above.]

Section 23. Whoever unlawfully has sexual intercourse or unnatural sexual intercourse, and abuses a child under 16 years of age, shall be punished by imprisonment in the state prison for life or for any term of years or, except as otherwise provided, for any term in a jail or house of correction. A prosecution commenced under this section shall neither be continued without a finding nor placed on file.***********

Imagine a situation like this: Two partners are 17 and one turns 18. According the the law, it seems that the age of consent is 16, and so the two 17 year olds would be able to have intercourse, but then suddenly when one turns 18 they would not be able to? Please help I am so confused...

Thanks,
Eli

Up to the parents

If the parents wanted to file charges then you would have problems. The police almost never does anything in those cases, but if a parent pushes the issue then you're screwed.

Not a lawyer, but I did seek advice when I was 19. The MA laws look almost like the laws here.

yeah but

ok well, basically I want to cover all my bases, and no need to get into a situation where one would even have the option of having to go to court or eventually even possibly being considered a sexual predator / whatever for doing what was legal a day before you turned 18 but suddenly isnt legal when you turn 18

so does anyone have any more definitive advice/interpretation of the laws so i can move forward. I dont think a good course of action is just to "hope" that the parents dont press charges. but i appreciate your thoughts

Please move this to the non-tech "Speakeasy" forum...

How?

How would I go about doing that?

sorry, "move" not the most accurate term...

I'm not aware one can "move" a thread, but rather create a thread in Speakeasy and instruct folks in this thread (include link) to pick up the discussion there. That's all.

I kinda wish there would be a "BOL Town Square" forum for non-tech topics like this. I don't think Speakeasy really has that many Buzztown citizens, but I'm not sure.

I understand that there's a bunch of comfort amongst Buzztown citizens and so bringing up non-tech topics here may be second-nature. But, although I wish you well to get the info/insight you need, I don't see a strong enough connection to this forum, ya know?

Best,
Shalin
