Personal news, good and bad

Apr 29, 2006 1:48AM PDT

I've been placed on non-disciplinary suspension from work, pending the outcome of the charges against me, to avoid possible pr problems for my employer.

My application for unemployment coverage has been approved, so that gives me some breathing room for job hunting.

I don't know who exactly my attorney has used the evidence packet with, but police presence in my neighborhood has markedly increased. They drive through about once every other hour, and stop and sit right in front of my place, which discourages a great deal of illegal activity.

Apparently the same is going on in another neighborhood. I received an anonymous phone call of someone screaming obscenities at me, and talking of "police drama, up and down someone's block". The phone number on star 69 revealed that it was made from the home phone of Hoodrat's residence. Star 57 made a record of the phone call, which shows further harrassment and violation of the no contact order between us.

So at least there is some good. I would have liked for some arrests to be made and for the DA to file charges based on the evidence, and to pursue them as zealously as they're pursuing the charges against me, but no luck. On the other hand, at least the police are doing something.

WOW!

Sounds like I may have missed something of what's going on with you. Thought you worked for a private security firm? IAC, whatever is going on, you have my thoughts and prayers that it works out for you.

Thanks ... and WOW!
Apr 29, 2006 2:15AM PDT

I'm so sorry to hear this. I think the media route mentioned in the end of that thread is a good way to go. I hope this works its way out without the drama of a trial and all that. And, as you so selflessly pointed out, that this girl can continue to move forward "clean".

I think what my attorney did
Apr 29, 2006 2:24AM PDT

was threaten to go to the media, thereby embarrassing just about everybody in law enforcement in lehigh county, especially those who are elected, like judges, magistrates, and DA's. Plus, there has recently been a lot of press about the high cost of police pensions in Allentown, where I live, and now the question would be, exactly what are our taxes paying for if the police are being paid to ignore criminal offenses in the face of overwhelming evidence and repeated calls for action. Whatever happened to the oath to Protect and Serve?

It comes from.....
Apr 29, 2006 2:47AM PDT

...... their being re-active rather than pro-active. They'd be as busy as bees if somebody was killed. (Maybe, depending on whom.)

And if your Good Samaritan action had not involved one of the darling "minors". For goodness sakes, Steven! You scared the innocent little fellow. Don't you know that minors are incapable of committing adult crimes until they're 18 years old? Arrrgh! Apparently, in your county, a person cannot protect his property from those "good little boys that society made." Double arrgh!

And everybody wonders why people are afraid to get involved!

I am mystified
Apr 29, 2006 3:39AM PDT

I am mystified by the behavior of local officials in the light of video tape evidence you say you provided.

I can say that I worked sometimes with local county sheriffs office special drug task forces when I worked with kids in lock up in WV. The task forces receive special funding every year to continue their efforts... funding often contingent on their past performance. I wonder if this might be the jurisdiction of gang crime units (with Allentown between Philly and NYC I'm sure you have some local task force coverage) or even State police?

If your involved in the security business then you and/or your lawyer might use your contacts to see if there are special teams in the area that might be better suited to pursue this matter. It may not help your case but might be of assistance to your neighbors daughter.

Good Luck

There is a special task force but they don't want my help
Apr 29, 2006 6:11AM PDT

and I think I know part of the reason why.

I'll try to find some links.

They have never considered me to be "one of them," as it were and consider my work to be "pissing in their pool." Up to 6 months ago I was working as a fugitive recovery agent, going after bail skips and prison escapees. According to the US Supreme Court, re Taylor v. Taintor, this is a law enforcement function and those who engage in it are law enforcement agents.

According to a recent ruling by the PA Supreme Court, again I'll try to find some links, Sheriff's and their deputies are not law enforcement and cannot perform criminal investigative actions such as wiretaps as a result. The majority opinion of the court is that Sheriff's and their deputies have no more law enforcement authority than a private citizen, and a private citizen cannot be considered any type of law enforcement.

By the same token, I and those like me, are commonly viewed in the same light as vigilantes and other undesirables, and any attempt to help is viewed as poking my nose into something I shouldn't or stepping on the wrong turf.

This is not true of all law enforcement. In Allentown and New Jersey, we have been told by the police that if we need backup, don't call them, because we shouldn't be in the law enforcement game at all. In Philadelphia, and particularly Chester Township, the reverse is true. We've been told not to hesitate to call because we also enforce the law and are therefore "brother officers" no matter who we work for.

Sadly, not everyone is as eager to help or be helped.

thats a crock, brother... sorry.
Apr 29, 2006 6:52AM PDT

no one wins when everyone gets protective of their turf and forgets why they are doing the job. I always had the advantage of being "requested" to help the cops in the local area but I did get flack sometimes from distant jurisdictions when tipping them off to alleged perps or juvenal runaways. They viewed me as a pain in the butt social worker when they didn't need me (sometimes I was Grin) and their best friend when they did.

The neighbors daughter... does she have a PO? Or even getting her rehab involved might help your situation. Didn't mean to be preaching to the choir if you thought of this already.

Your in a tuff spot... hang in there and good luck.

She does have a PO, and a mentor, and she keeps in touch with her counselors from rehab.

And some more news.

The police arrested someone in front of my house about 20 minutes ago, I didn't get to see who, but from the back it looked like someone with blonde hair so it could've been Hoodrat. I heard a commotion and looked out to see someone being taken down, and noted that my car and that of my neighbor's mother had been egged. I tried to inquire about more info but was told this was a police matter, get out of the way, and go back in my house.

I've emailed my attorney, of course, since my car was one of the ones egged, he should be able to shake loose some info that the police aren't currently willing to share, sometime tomorrow of course.

I had a knock on my door a few days ago
Apr 29, 2006 6:56AM PDT

and I looked outside and from the looks of the car, I told my wife it was probably going to be a process server (and it was) I had already got two separate subpoenas for this case before this one so I knew it would be coming soon. I explained to my wife what that guy did for a living and suggested it would be interesting but she thought otherwise. Good luck. Too bad guys like "The Dog" muck it up for you guys.

My former boss in that line of work hates the Dog
Apr 29, 2006 2:35PM PDT

but then the dog was convicted of armed robbery and murder, which makes everyone in the business look bad.

I left that line of work about 6 months ago when I saw myself becoming someone I didn't want to be. I walked in with my boss and my assigned partner on a horrific scene that is best left undescribed. It still gives me nightmares. Anyway, though it bothered my quite badly, it apparently didn't bother my boss or partner. They told me that they'd seen that sort of thing so often that it was routine, and that once I'd seen it often enough it wouldn't bother me anymore either.

As much as I can't imagine it not bothering me, I don't want to chance it occurring. I believe that a part of being human is to be bothered by certain things. They are meant to horrify, so that people won't want it to occur. To lose that, is to lose a very important part of one's humanity.

So I left that line of work, to hold a full time position in security, and a part time position in private investigation. And I'm usually much happier for it.

I was looking for

http://www.aopc.org/opposting/supreme/out/j-47-2005mo.pdf

this one is regarding Sheriff's and their deputies not qualifying as law enforcement, you'll need some version of the acrobat reader to view. If you don't have it, I hope you're not on dial up as it will take hours to download, which is part of the reason this took so long to get the link here. There were several postings off the PA Supreme Court site that it could've been, but I needed the reader to check them.

Oath? As far as I can tell, Protect and Serve isn't talking
Apr 29, 2006 3:55PM PDT

directly about the general public. It's talking about who the police want to help. If you aren't on their list, forget it.

What a crazy, crazy situation
Apr 29, 2006 6:57AM PDT

I am just plain baffled and disillusioned by this mess, Steven.

You have my support, as well as my prayers and good thoughts coming your way. I truly hope that you are able to have a positive outcome to this both for you and your neighborhood.

Hang in there!!
