Opinion: Apple is testing: Magnuson-Moss Act, thx Slikkster

Nov 24, 2009 7:12AM PST

Dear Buzz Crew and Gang,
Slikkster had an interesting post regarding Apple and their stance on not honoring warranties of customers that smoke tobacco products. Apple may want to go back and check the cases:

Albanese vs. Compaq
http://www.law.com/jsp/PubArticle.jsp?id=900005421704
&
Pope v. Compaq
http://findarticles.com/p/articles/mi_m0EIN/is_2001_April_30/ai_73818292/

In both cases, the courts indicated that: "US companies can limit, but not exclude, implied warranty rights for products."
Also:
"The implied warranties on consumer products may not be disclaimed if a written express warranty is given."

Apple may not win this fight.

Later People.
