If the IP-address is in the range that DHCP uses to give IP-addresses, it's dynamic. If it's outside that range, it's static. Would that be a useful algorithm?

If the DHCP-range is 1 to 255, than all in that range are dynamic and non are static. The static IP's you define yourself should not overlap with the range of IP-addresses that is managed by the DHCP-server (the router).
The D in DHCP stands for 'dynamic'.
