Long Past Time To Impeach 9th Circuit Court

Toss the whole court out and replace them with real judges instead of activist judges. Here's one of the big problems in our country and seemingly little being done about it. The latest outrage has been their handling of the illegal alien invasion going on in border states as Arizona for one is trying to deal with it. Either replace them, or disband them and move the cases into courts better equipped to follow law than rulings based on conjecture and personal whims of arrogant judges.

Over the past decade, the U.S. Supreme Court has overruled the U.S. Court of Appeals for the Ninth Circuit in 148 of 182 cases?a ?strikingly poor record? for the circuit court, said Ninth Circuit Judge Diarmuid O'Scannlain ?63 in a talk at Harvard Law School on September 17. The event was sponsored by the Federalist Society.

O'Scannlain, who is entering his 25th year on the federal bench, said ?got it wrong in 81% of its cases that the Supreme Court agreed to hear.?

?Compare that to the affirmance rate of over 80% in all appeals from lower courts and federal agencies decided by us.?

The circuit?s reversal rate troubles the long-time and much distinguished O'Scannlain, whose appellate division spans from the northwest United States and California to Alaska and Hawaii.

?Even more telling than the reversal rate itself, however, is the number of unanimous reversals. Seventy-two of the 148 Ninth Circuit cases reversed during the period in question were at the hands of a unanimous Supreme Court.?

Some of these cases, according to O?Scannlain, are ones in which the circuit court?s error is so significant that...(read article for more)

It would be nice...

But I'm not gonna hold my breath. I don't think reversals is grounds for impeachment.

what is?

Seems judges should be held to a standard of upholding the law too. If running a rogue court isn't grounds to impeach or by some other means to replace those judges, then we the people are no longer in charge. We need a way to clean out the court system once in awhile, all the way to the top. The biggest mistake by our forefathers was believing in the honesty of judges who supposedly make a habit of learning and adhering to law. They are just as fallible and just as needful of removal at times as any politician, yet the process is basically non existent since it's rarely used. Continual over rulings, especially where in some cases the 9th has deliberately ruled against the Supreme Court on a previous ruling through a new case along same lines accepted, should be ground for those judges to be removed. It might take a coalition of governors standing up and denying to allow any court cases to proceed to the 9th and threatening to take if further if necessary to get something done. This country is heading for a breakup unless things change, quickly.
