IPOD is it worth it or should I just...

I have a brand new out of the plastic case IPOD nano 2g silver never been powered up as this unit will not show the apple logo will not even show up on any of the apple/Itunes programs. I have tried using earlier versions of Itunes to see if I could get the restore function to show up with this unit, but even the restore will not show. Does anybody have any suggestions or ideas besides smashing this unit with a sledghe hammer. And yes I did write Apple and their respons was to mail it in and they would send me a used one for a small fee of about $149.00 + shipping & handling. Doesn't seem fair I purchase a new unit have the receipt and all and the company all but slams the door shut on me.

sorry to hear that. if you have the receipt and proof of purchase, try returning it back to the store you bought it from for a new one maybe that'll work Happy

If in warranty you should have no trouble getting repair, replace or refund from retailer (or perhaps from Apple).

If out of warranty, under most countries' consumer law you should be able to get same from retailer within a reasonable period.

In English law you have a right to expect reasonable use (say 5 years) of a consumer durable product such as this, especially regarding the high price.

I have heard of the Apple Store in London trying this ludicrous 10% off a new one deal, apparently in ignorance of English law. I suggested that the customer sought advice of the local council's Consumer Protection department and, with their guidance, considered the small claims court.

If it's straight out of the box and it just doesn't work whatever you do (according to manual, of course), then it must be a lemon. I guess you could try contacting Apple and going back to the store that you got your iPod from, but Apple has an extensive history of not honouring their warranties. Chances are, if you send your iPod to Apple, they'll just say that it was water damage. (That's what a lot of other people are complaing about on consumeraffairs.com.) And they "refurbished iPod" thing - you could try, but it might end up as a waste of your $150, since a lot of people got refurbished lemons.
That said, the shop you bought your iPod from might refund/exchange it.
