What sort of Mac do you have?
Is the "primary" drive, the only drive that you have in that machine?
You CANNOT restore OS 10.3 by just copying it to the hard drive, it has to be installed using the installer. You kinda say that you did this. You should now have a bootable HD which will come up in 10.3 Apparently it does not do this. What else did you do to the machine?
After booting from the Restore disks, the grey ones, and choosing Restore, the rest of the process is automatic. It leaves you with a HD as if you had just opened the box.

I am trying to erase my volume on the primary drive. it used to have os9.2 and osX10.3.5 on it. The actual disks i have are for os9.1 and osx 10.3 (it doesnt list another decimal). I have Done it in and actually "restored" the volume by copying the osx 10.3 upgrade disk directly onto it using the restore function after starting from the osx upgrade disk. so now the old stuff is erased but i have nothing to start on on that drive. when i put in the os 9.1 install disk it just freezes at startup (maybe this is not a bootable disk???) and when i put in the osx disk it says there is no earlier version of os x installed.
