HP Spectre x360 vs Surface Pro 3?

I am looking for a device that can do the following for around or under 1000
-play light games (league of legends mostly)
-handle light photo and video editing
-be carried around constantly on weekdays
-long battery life
-pen-enabled touch screen

I am a student that loves taking notes by hand and it's faster for me when it comes to compacted equations however I see that both of these devices are pen enabled.

According to me needs and me being a student, which device would you recommend?

I'd read http://www.surfaceforums.net/threads/bought-surface-pro-3-for-gaming.10075/ again as folk go over heat and tweaks. This is not a gaming machine. That doesn't mean it can't game but you now know what's up.
