H.P./ Nvidia Settlement

I have just been notified of the Nvidia settlement regarding a laptop i have. The golden part of it is that the settlement is supposed to include REPACEMENT of the laptop. The settlement is because of a defective Nvidia Graphics Processor and/or Communications Chip.

I had a DV2100 laptop that had to be sent back to HP once for the wireless system crashing after it was out of warranty. Now the entire system is doing the same thing, not locateing a wireless signal, and when connected to a hard line will not aquire a I.P. address. Other computers companies are also haveing issues, but are only applying repair instead of replacement. From what i can find on the internet......this is because H.P. knew about the issue and tried to cover it up using a "bios" update, which made the systems overwork itself by running the fans faster, longer, and componets got hotter, thus the life of the computer went down.

I agree that what they're trying to do isn't fair in many ways. However, it's important to read all the rules before making assumptions about the claims process. This is from the sample claim form:
"Proof of purchase can be a sales receipt, credit card or other account statement, shipping manifest, purchase order, proof of registration, or such other documentation that the Administrator deems ?. If you cannot locate a receipt, please provide the product identification number found on the back of your computer, along with the approximate date?"
I'm pretty sure most of us didn't pay cash, and credit card companies can get you statements from years ago. Also, it doesn't say that you won't get a reimbursement if you don't have that. And from what I can tell, they either approve or deny the claim before the computer is sent in. I'm guessing they will just look over the machines to make sure the numbers match up and that they weren't abused by "crushing, burning or malicious dismantling of components." Now I can't say if they'll stick by this or not, but that's what the website says. As far as the people who got rid of theirs, I'm not sure. But I would call the lawyers just in case there is an option for that.

Proof of Purchase

I had the same probem , no receipt any more.However I contacted Office Depot, told them the approx date that I purchased and they immediately E mailed a copy receipt. Try it with the store that you Purchased from and they will probably be able to do the same.!

Fantastic, that you were able to obtain this from the store. I do hope a lot of other people can locate a 'proof of purchase,' too.

I filed a claim, but I am still waiting for acknowledgement via e-mail. I mailed the required paperwork January 14.

I seemed to have misplaced the receipt for my laptop that I got 3 years ago, and I don't think I can contact the company and ask for a payment statement since I got my laptop from Circuit City and paid for it with a Circuit City credit card. As we all know that company went out of business a few years ago, and I never bothered to register my laptop right away (who really does that anyways?).

I purchased my HP Pavilion Tablet tx1417cl at Sam's Club in mid 2008. I really enjoyed the versatility and power of the tablet PC. I have the original box and on the side it has the following features: AMD Turion 64 X2 TL-62 2.1 GHz processor, 12.1" WXGA HD BrightView widescreen with touchscreen, 250 GB hard drive, 2048MB DDR2 SDRAM, 802.11b/g WLAN, LightScribe Super Multi 8X DVD+-RW double layer drive, 6 cell LiIon battery, HP QuickPlay, HP Mini Remote Control, 5-in-1 Digital Reader, ExpressCard/34 PC Card Slot, nVidia GeForce Go 6150 graphics, Windows Vista Home Premium, 1.3 mp Webcam, Fingerprint reader, Headphones, and Expansion Port 3.
Although I appreciate the gesture for the class-action suite, the Asus Netbook with the Intel Atom processor is not a suitable or comparable replacement. HP and/or nVidia manufactured defective tablet PCs/notebooks and/or graphics cards. I would like to have a tablet PC; not a Netbook that is comparable to the laptop I purchased with speed and features.

The entire settlement is a joke. Buying expensive computers that have issues and getting low level, lame replacements is totally criminal. The companies did not step up to the integrity that they should have. What a JOKE!

If you are unhappy with the computers that Milberg "negotiated", be sure to make your opinions known by contacting Jeff Westerman at Milberg LLP directly at 1-877-692-1965 or 213-617-1200. Nothing will change unless you make Milberg know that the computer they're offering is a POS (it sold for $250 on Black Friday), while many of us paid well over $1000 for our computers that are still way better (with the exception of the defective GPU).

Contacted Millberg LLP and spoke to him, basically we got screwed.

Contacted HP...

Contacted the settlement group...

Now I will try to contact nvidia.

I, too, have already submitted all my paperwork and proof of purchase but have not heard anything back from the Administrators. I am not happy with the laptop offer and found the above web site. It takes about 10 minutes to fill out, but could be worth it to submit it to the folks that administer the settlement.

nvidia settlement replacement with an inferior cq50

Maybe we need a class action suit against the lawyers if they settled for less than an equal replacement. I am not looking for better, but equal. It is like going into a restaurant and ordering a steak. The cook screws it up, so they replace it with a hamburger.
I sent the following letter to the Group of lawyers that settled this class action case. What they are offering is inferior to my laptop.

Claim # NVF-XXXXXXXXXX

Reading the settlement site it informs me that they want to replace my laptop with an inferior model.

I expect the replacement to be at least equal to my HP Pavilion dv62xx/dv63xx that is a Special Edition Multi-media Edition that has a HP Pavilion Web Cam, Altec Lansing Sound, with a Compaq Presario CQ56-115DX . The replacement stated on the settlement site is inferior to my laptop since it is not multi media. It has no camera, and checking the Benchmark Speed (how fast it processes) it's AMD V140 is much slower than my AMD Turion X2 Dual Core.

I filed my claim about 2 months ago, still haven't heard anything like many others. I think I'll file again just in case.

I own an HP tx1000 tablet which I purchased in late 2007. VERY unhappy with the settlement right now. I remember before the judge approved, I was a bit skeptical of the whole because they never listed what replacement computer I would receive. "Similar in kind and value" wasn't enough for me. Nevertheless, many of legal expert friends informed me that it would sufficient, "even if you get tremendous upgrades". They don't seem very "expert" now do they?

My computer has a dual core 2.0 GHz processor, 2 GB of RAM, 250 GB hard drive, DVDRW, a touchscreen, a fingerprint sensor, bluetooth, etc. This Asus and Compaq they are trying to offer us come no where near my current notebook. I think we would have been better served just receiving new motherboards. If the replacement computer is missing any of those things without having some kind of improvement in another category, I will feel this is unfair.

I emailed Mr. Westerman, and he got back to me a day later. I was complaining about the Asus they want to give us and his reasoning was "If you read the website, you will see that HP tablet owners have an option between 2 computers". Wow. So I guess he assumes that the Compaq will make me feel better.

One thing he did say, is that tomorrow they will be updating the website and explaining how the Asus will have "upgrades". What kind of upgrades do you think we're talking here? I mean the Asus needs an upgrade in pretty much every category! I'm content getting a laptop with equal specs, I'm willing to look past the Asus label. I just hope they don't give us the same computer with 250 GB of hard drive space and assume that will make us happy. The machine doesn't even have an optical drive for crying out loud!

Replacing the Motherboard on the existing machines ? Maybe this is not a bad idea in view of the junk that is being offered for replacement. However we would have to ensure that these are upgraded motherboards without the same ihnerent problems that will result in failure in a few months. Does anyone know how Tablets were repaired ? New heat sinks, etc ?

So far the failures continue. The few folk I know report that the machine did last about as long as the first time so the cause of the failures (which is easy to find out the details) was never resolved.

HP continues with other failures in other lines and no sign of remorse. Something bad has happened at HP and for now I have to write "avoid" this maker until they have a change of upper management and the entire board.

I had an issue with them, concerning this same computer about a year ago. It was overheating beyond belief. I sent them a picture of 2nd degree burns I had gotten as a result of sleeping with the computer on the nightstand. My arm was on it for a few minutes before I woke up in pain.

The responded by saying there was nothing wrong with the computer (lol), but they would be happy to change the motherboard at my own expense. You'd think they'd mention this Nvidia law suit at least.

HP Repaired my TX1305US Tablet

About a year ago HP repaired my TX1305US tablet computer. Which had suffered from overheating, loss of wireless connectivity, then eventual video loss. After much back & forth, they agreed to a discounted price, but I still had to pay.

They replaced my motherboard, display, keyboard and hetsink fan.

My computer works great now (like new), and although I filled out a claim form for a replacement, I don't want to trade it in for a dumpy little netbook. I use my fingerprint reader and DVD drive all the time. I also upgraded to Windows 7 and maxed out my RAM.

Why should I downgrade and lose my investment because HP/nVidia can't fix their inherent overheating GPU problem?

My tablet also came with a remote control, and although I haven't been able to get it to work with Windows 7 yet, I don't see this feature on the proposed replacement unit.

HP should really be replacing the TX1000 series tablets with their tm2t series tablets which currently sells for around $800 and is much more compatible in features. This will cost them a little more money than the $300 Asus netbook, but if they stopped paying lawyers to fight this they would probably have more money to cover the costs, and they would have happier customers that would return to HP for future purchases -- like those other guys at Ap*le.

I already submitted a couple of forms tru the webpage and no answered received yet. When I call to the 1877... it is only a automatic call but no one can attend you. The deadline has passed w/o any activity. I've all the information needed including proof of purchase. Can someone provide more guidance on how to proceed if we haven't received answer yet?

I printed that page out and sent it as my proof of purchase (since it was a year before it expired).
About 3 weeks later I received a letter from them telling me what to do next. It told me to take the letter along with the laptop to Fed-Ex and have them pack it and ship it back to them.I did this on March 12,2011.And got a receipt for it.
NOW ITS A WAITING GAME TO SEE WHAT HAPPENS NEXT!

I agree. My laptop was over $1300.00 us. This is unacceptable. They are taking the path of least resistance and trying to save a buck. Again. Here are the emails of every attorney that was directly involved and got a cut of the $13 Million for their fees. I highly encourage every person to drop them a line. I will be posting a video on youtube soon about this. We have to fight this. They are going against Judge Ware's order plain and simple.

I sent the electronic information in about two months ago and and was recently approved. My defective H.P. arrived at Nvidia in CA on or about the 19th. I am starting to wonder if they are going to wait for the judges decision on the 28th regarding the specs of the replacement laptops being offered before they ship anything out. The settlement website seems to be getting updated with information regarding the "specs" of the laptops, so im sure they will fight this. I just know that the whole process has taken much longer then the 4-6 weeks origanly stated. At this time I just want this whole thing to be over and done with. So far I have done a whole lot of running around between tracking a proof of purchase at bestbuy and and going to a FedEx to ship it back. I just hope its all worth it in the end. haha.........at any rate, my expierience with H.P. has been bad, from customer service reps that can barely speak english to them charging me $780.00 for a repair of this problem which they said was covered under the extended warranty. I know outsourceing is common, but this has been a nightmare from the start. Good luck to all and I'll update with any results.

I received my replacement yesterday 6/23/11. So it took a little over 4 months, from the time i filed the claim.
