H.P./ Nvidia Settlement

I have just been notified of the Nvidia settlement regarding a laptop i have. The golden part of it is that the settlement is supposed to include REPACEMENT of the laptop. The settlement is because of a defective Nvidia Graphics Processor and/or Communications Chip.

I had a DV2100 laptop that had to be sent back to HP once for the wireless system crashing after it was out of warranty. Now the entire system is doing the same thing, not locateing a wireless signal, and when connected to a hard line will not aquire a I.P. address. Other computers companies are also haveing issues, but are only applying repair instead of replacement. From what i can find on the internet......this is because H.P. knew about the issue and tried to cover it up using a "bios" update, which made the systems overwork itself by running the fans faster, longer, and componets got hotter, thus the life of the computer went down.

I'd be fine taking something working in the place of my hp craptop, but if the replacement is 1/3 of the value of my machine i shouldn't have to send it in. my old parts are worth more than this asus turd.

If you call settlement number, listen to the options, press '4' to make a claim and then press '0' you will be connected to a person. Worked for me.

Does this promise an hp replacement (not asus)

From the nvidiasettlement.com FAQ #9:
"NVIDIA has also agreed to provide a replacement HP notebook computer to Class Members who bought certain versions of some HP notebook computers that contain an NVIDIA chip and who send in a valid Claim Form, appropriate supporting documentation, and (if the Claim Form is approved) their eligible malfunctioning HP notebook computer. The replacement HP notebook computer will be of similar kind and value as their eligible malfunctioning notebook computer."

I suppose they are saying that the "replacement HP notebook computer" is the Asus netbook.

But there is no way the Asus is of a similar kind or a similar value. The only argument I can think to make is that the $1400 notebook I bought has depreciated to a value of $500, so it actually is of a similar value. But it is not even in the same class of computer. No one with any understanding of computers could argue that it is.

I feel like I'm being shafted. This is not a fair settlement.

They are doing wrong. You bought a new laptop with a defected chipset from the design. That means you paid $1400 for a brand new but defected product from beginning. From fair trading rules, you should get the all money refunded. So now they should replace the same configurations as yours if there is no money reimbursement. No consideration of depreciation in this settlement per my understanding, because the defect existed from early beginning.

At least "similar kind" means similar configurations. They cannot replace a high end labtop with a netbook with slower single CPU, 1GB RAM, small HDD, and no optical drive.

They are greedy and cheating on this settlement.

$1000 HP TX series is equivalent to a $464 Asus

Apparently HP and nVidia must have agreed that HPs TX series is equivalent to an Asus T101MT-EU17-BK because:

* 12.1" HP display = 10.1" Asus display
* dual core processor on HP = Atom processor on Asus
* lightscribe optical on HP = no optical on Asus
* $1000+ HP notebook = $464 Asus netbook

With this kind of analysis, does it surprise anyone that HP/nVidia couldn't build it right in the first place?

Let's not forget that it took 3 years for them to admit they messed up - and only because the law forced them to.

I recently replaced the motherboard on my HP tx1305us. Now that it's running again, should I downgrade to a netbook? At least this will get rid of one HP product in my house.

Yea, this really made me mad. It is not so much that i expect a ton out of any class action suit, however, when we are drawn into signing on to the suit with the promise of: "The replacement HP notebook computer will be of similar kind and value as their eligible malfunctioning notebook computer." I feel a bit cheated when I am offered a netbook with the only similarity being that it's screen twists and folds.

After doing a lot of research, I found the direct contact line for the firm that dealt with this case. If you want your voice heard, I would recommend calling and letting them know your disappointment!

It is called Milberg, LLP. Someone will immediately pick up the phone and when you tell them what you are calling about, you will be transfered immediately to another live person from the firm. Good Luck! This is the best i could do. If enough of us call, they may at the least offer us a different laptop or the option to take the $value of the netbook rather than being force-fed a underpowered netbook we dont want..

Violation of NVIDIA GPU LITIGATION settlement terms

It is obivious that the Administrators are violating the terms of the judgement, We have contacted Ted Frank from Center for Class Action Fairness.

Today, Ted has email the counsel Jeff Westerman and Robert Varian, asking them to provide a written explanation by the morning on January 18th 2011 about these replacement computers that we are being provided in lieu of the defective HP laptops.

Please send Ted an email at tfrank@gmail.com to show your support and join the initiative to get a fair replacement.

I received an e-mail today, stating the filing time for this settlement. My claim filing will be from January 13 to March 12, 2011. I sent, or thought I sent a claim yesterday, but apparently it did not go. So, I will go to the library where I can fill out the form and print it. I will go to a copy store to get a copy of my 'proof of purchase.' I will be good to go with this filing and I will be glad to be done with it.

Next is to WAIT. It states that the transaction from onset to finish should be 4-6 weeks. This should mean that I get a workable computer in that specific time-frame. By the end of February, I should have a functional computer.

I write, but at this point, it is not for profit, or I'd be able to purchase another computer. When I get my new computer, I will be sure to 'baby-the-baby,' or at least until I get rich and can afford to make replacements every-so-often.

Thanks for filing this complaint, it sounds like the Center for Class Action Fairness could be helpful for us. However, I just found their website, and it looks like they're just bombarded with e-mails about this. Maybe read a bit about the center before you send more?

Remember, he is YOUR lawyer in this case and you have every right to contact him if you don't approve of the settlement. After all, they're getting paid for doing this!

When I e-mailed Jeff Westerman, he set up a time to talk with me and I explained why the Asus netbook is not similar to my laptop. He told me to watch the website because there could be changes made to the settlement. However, he also told me that it's a settlement, so it's not going to be perfect and that things may not change. So I'm not really sure what to think...

As I see it, whenever there is any litigation, the party to gain anything is the lawyers involved. If there were no litigation, they would not get any money. Business is out money and the people don't get their fair share, but the lawyers stand to gain a fair amount from this settlement, as do they from any settlement.

Who is ruled out from the get-go? Well, those who have no 'proof of purchase' and those who threw their computers away. Of those who file, their machines will be thumbed through to see if the problem is related to the NVIDIA graphics design flaw.

I'm not sure any of the replacement computers are comparable to any of the computers, which were purchased and failed? Big business gets their hands slapped and the consumer gets a pacifier. We all go our separate ways with maybe a lesson learned, or at least, one tucked under the belt. It only makes us a little more cautious of the next deal we undertake.
