Yes it is Illegal but only opponents of the administration (at whatever time) are threatened with prosecution or pilloried in the public press.

There is a standard response in Britain when somebody does something that is wrong but is not quite worth prosecuting. It is called, quite formally, "Naming and Shaming" the culprit. And you will see stories regularly in the newspaper like "Lord Jeffrey Archer Shamed Again: Eighth, or 25th Call girl says he spanked her silly wearing a tutu!" or some such approach. He sued for libel and lost. Twice.

I advocate this for the treatment of significant offenders like Bolton. Something like a one or two page spread in the Times or the Post delineating his whole career and the accusations that trail him like the odour of a homeless persons socks, with as much corroborating evidence as possible. Then just sit back and watch him try to fumble up a law suit. It should limit his employment prospects for years to come. Or is punishing the over-paid, abusive, hatchet-man, bully by hitting him in the wallet considered unsporting, or Un-American.

was acting within the "job description" of his official government duties.

It was illegal for Kerry because he acted in direct contravention of both the Constitution and the UCMJ.

Consider yourself "Named and shamed".
