Brady Lake Police Department assault citizen over asking questions about a ticket. Mention attorney and get worse beat down.

I was stopped for front license plate. I'd
never had an altercation with a police
officer so I never even considered
recording what I thought would be a
uneventful stop.

I don't know why but the officer was extremely
irate from the initial encounter. He tried to get
me to verbally admit I buckled up after his lights
came on. I rightfully denied this and he was
furious.

When I told him my front license plate fell off
due to a broken bracket, he lost it and with
vulgarity ripped me a new one.

He went back to his car for about 30
minutes while I became very impatient.

A local sheriff stopped by likely because I
called expressing concern for my safety. I
also wisely thought to begin recording
with my phone .

When the original officer came back to
my car, his tone was totally different.

I was charged with Failure to Comply,
Resisting Arrest and the no front license
plate. All but license plate was dropped.

The officers lied through their teeth on
their police reports and cleverly had
BOTH dash cams wiped. They didn't
know mine was still going.

Points to note that saved my ****.

On the officers police reports, they put they had
to slam me to the ground to put cuffs on me to
justify the assault. Not only did they lie on the police report but they completely made up an elaborate hoax of a story!

As you can see I was clearly cuffed immediately without resistance after coming out of the vehicle.

Before the Brady Lake officer Marlon Webster decided to
cheap shot spear tackle me into my car, the other officer
acknowledged that I had a concern about rights.

I was even at one point offered all charges
dropped if I signed a paper that I wouldn't sue.
I refused.

Also its important to note that over a front
license plate. I had to sit for like 12-15 hours in
a holding cell with a bunch of guys trying to
teach me how to get drugs into jail sticking it in
your butt. I missed work, and had over 700
dollars in bail tied up for the full year that the
courts snowballed this case.
I was even at one point offered all charges
dropped if I signed a paper that I wouldn't sue.
I refused.

I went from from trusting police to now I will record EVERY
encounter from start to finish. I literally
am deathly afraid of the power police
hold and fear the fact that they can
destroy your life just with a single lie.

I think I had a pretty legitimate question
about the ticket considering Brady Lake is
a small village and I was pulled over on
State Route 261 in Kent by Klaben very clear of
any obvious Village of Brady Lake jurisdiction.
Even if it was the stupidest question on earth, I'm pretty sure I never waived my right to free speech.

Ryan became very combative and ignored my commands to stop resisting and place your hands behind your back as well as Dep. Hoffman's commands to stop resisting also. Dep. Hoffman and myself struggled and fought with Ryan on the ground for an extended period of time to place him in a stiff arm bar lock to place him in handcuffs. "

I've never fully comprehended how easily it was for cops to just manufacture stories to fit the situation. Without this video I would have GUARANTEED been convicted. Its obvious why cops don't want you to record them. They have to be honest or the whole system fails!!

That it could happen about like he said, that some cops, esp small town ones, are often bullies at nature.

But it also looks like he deliberately carefully baited the officer. I can believe he orchestrated the entire confrontation after he started the phone recording.

I'm not sure what it says about me that I could believe one just as easily as the other.


Question though, if both cops "cleverly" wiped their dash cams, why would they leave his recording when he told them he was recording? or maybe I missed something and he actually streamed it via cellular connection? can you stream live from a phone to somewhere and make a recording that way? Even if you can stream it live to another storage device, why would they not have slapped it into the foot as soon he stepped out.

Regarding stepping out, at a minimum he deliberated stalled at everything the cop asked him to do. Just insisting on his right to understand the accusation? or just getting off yanking the cop's chain?

I hate to be so cynical, but it seemed everything he said was calculated to irritate the cop while without sounding totally out of line, esp to a sympathetic audience, or civil jury.

These cop abuse sites bother me a bit, while I'm sure there are plenty of such things happening, these type of site stories, even videos, always seem calculated to be as dramatic and damning as possible. No doubt they are agenda driven.

but it does seem that way too many young people have been taught that the world revolves around them and that no one has authority over how they behave. From the time they're put into school, they're parents defend their every action if a teacher attempts to discipline them. Lawyers are waiting to take action so school officials are walking on egg shells if they dare to take a disruptive student to task. They must even be careful not to hurt their little egos. I didn't hear anything in the officers voice or instructions that were half as disrespectful as was this young person's behavior. His argument that the license plate had fallen off confirms that he knew it was missing. Therefore, if his state requires a front plate (some don't) he's guilty. Children seem to be taught to never admit fault. Again...the lawyer mentality. The video shows clearly a kid caught in the act who severely lacks personal and social skills.

All he'd have to do is say he knew the plate was missing but his errand was of some urgency. If he's polite and gets an average cop, he get's a warning that has a compliance date in which to have the issue resolved. He carries that citation if he's stopped again. I had something like that happen to me. We use validation stickers up here in Ohio and I was stopped when mine was out of date. I actually had the new stickers in my glove compartment but hadn't put them on as the weather had been nasty. I forgot they were there. When I was pulled over, I wondered why as I wasn't speeding. A light came on about the forgotten stickers. I told the officer they were in the glove department but didn't reach in there immediately. He asked me to retrieve them and I did. He had me put the stickers on my tags but also said he was required to issue me a citation. He gave me a simple warning and no fine. No need to make trouble.

then put a sticker on the tag that looks legit from the road, but not when examined closer. Missing front tags should be given benefit of the doubt, so long as the rear plate is legit. Do you know how to spot a stolen front plate placed on the rear of a car with a fake sticker on it?

How to identify a stolen plate?

Well, in my state we have two stickers. One is the annual renewal and the other is the county of issue. The renewal sticker goes on the rear plate. What I do notice is that license plate frames partially obscure the stickers so it's necessary to position them askew from the area of the plate designed for them. I also see that license plate frames are more common on the rear and bare plates on the front. My guess would be that a stolen plate with fake sticker would probably find itself partially obscured by the rear frame.

Never argue with a street monkey, just sign the ticket and take it to court. Do people really believe a cop who has stopped you and said he's giving you a ticket will fail to do so if you run your mouth enough? If on camera, no judge will be impressed by how many words per minute you can spew out, nor how many times you can repeat yourself. Diarrhea of the mouth on the side of the road will not accomplish anything.

facing traffic both ways, record everytime I hit the road. Good for evidence in an accident, especially if not your fault. Also good for capturing the idiotic things people do on the road. Send video to any company when their truck driver decides to ride his semi tractor right on your tail for miles even though you are doing the speed limit. Good for speed traps where you can show exactly how the signs were placed that day.

Having a cam is very common is Europe, especially in the eastern bloc as Ruskies think they can walk and drive any way they want. So, if an accident happens, they have proof it wasn't their fault or whatever to bolster their case. It just seems that the OP cam recording was real good, too good, IMHO. But then many cars are gadget loaded. Just give me an old Ford or Chevy with a V-8 again. -----Willy Shocked

Please consider that I did not ask for this. I've been pulled over a bunch and had nothing more than a joke and handshake be the outcome.
The officer didn't put anything about me being hostile on the police report for the first encounter before i started recording. He wrote it out like he was super nice and respectful leaving out everything true.

Trust me I did not want to be assaulted and put in jail. I would much rather have been home. However I've seen enough of those videos to know when a cop could be dangerous. Go figure, it saved me being charged with a bogus offense.

Pretty sure there are no laws that say I lose my 1st amendment right to protest a ticket! Or is there law that gives a specified amount of time to sign a ticket? A viewer on youtube counted 57 seconds.

I seriously waited FOREVER after the emailing the department before posting this video. It happened in 2012 for freaks sake. I waited til now to post it because they never even returned my phone call.

Isn't that what the court hearing is for? honestly does anyone think it does any good to argue with the officer on the spot?

I'm not claiming that you'll always get a fair hearing in court, there is a natural bias in the system that if the defendant and the arresting officer testimonies conflict the officer is "more reliable" witness.

some judges don't like some cops

they get to know who is honest and who shades the truth. We had an interesting day in court for my daughter. She and her sister were gone Christmas shopping in the 2001 Dakota truck I'd bought one of them. Coming home there was an entrance ramp, right up from the DMV and courts too, so judge was familiar with it. The ramp was in terrible shape. The road under heavy vehicles actually would dip. Leaves had clogged the drain and that cold December day the water it had on the surface was frozen, the surface of road was rough and had potholes. The superstructure had the main beams rusting, some rusted through. To make things worse it was a narrow but tightly curving entrance ramp that went up and then came down at the bad area before it would enter the interstate.

My oldest hit the pothole then the ice and it fishtailed back and forth and did $10K worth of damage to the truck. Insurance covered it or I'd have sued the state for placing their lives in such danger. The girls didn't have cellphone with them, so exited truck crossed grass divide to other side and down the exit ramp to make call home from Bob Evans.

I come to pick them up, see cop parked by wrecked truck on other side, so stop and go across the divide to speak to him. He tells me to bring daughter back to the truck, which I did. He checked her license and started writing her up then got really harsh with her. I walked up and told him quite firmly if he had a ticket to give her then do so, but nothing more than that, and besides he was putting everyone in harm's way by not doing so quickly. He calmed down and then left after giving ticket.

I come back a day later with camera for pics and video. I had everything I needed to show how greatly the decrepit ramp was at fault including the multitude of other colors on the rails showing many had accidents there. I then did a video of a fuel truck actually bending the road down as it came up the ramp and then hitting the pothole and going through the eternal puddle which was not frozen that day. I climbed down and got pictures of the terrible rust underneath the structure.

Court day. Prepared to the max. Judge begins by questioning the officer who gave his story about it. Judge says the truck is in my name. Judge asks how the officer knew it wasn't me driving instead. Officer relates I told him it was my daughter. Judge asks him if he saw anyone driving the vehicle, or did he see the accident happen. Officer says no. Judge says he can't really testify to anything more than finding a wreck on the side of the road and anything after that is hearsay. A trick around here then was people who were drunk and then wrecked leaving the scene and callign someone sober to take the blame of an accident but them avoid a DUI.

We never presented anything, Judge declared the only evidence from the prosecution was a wreck on side of the road, they'd not requested an deposition either, so Judge tossed it all out. We never had to say a word, which just goes to show how much can often be gained by keeping one's mouth shut.
