Anti-Illegal-Immigrant Law OK'd in Texas

FARMERS BRANCH, Texas (AP) - Voters in this Dallas suburb became the first in the nation Saturday to prohibit landlords from renting to most illegal immigrants.

The ban was approved by a vote of 68 percent to 32 percent in final, unofficial returns.

The balloting marked the first public vote on a local government measure to crack down on illegal immigration.

"It says especially to Congress that we're tired of the out-of-control illegal immigration problem. That if Congress doesn't do something about it, cities will," said Tim O'Hare, a City Council member who was the ordinance's lead proponent.

The ordinance requires apartment managers to verify that renters are U.S. citizens or legal immigrants before leasing to them, with some exceptions.

Property managers or owners who break the rule face a misdemeanor charge punishable by a fine of up to $500.

Council members approved the ordinance in November, then revised it in January to include exemptions for minors, seniors and some families with a mix of legal residents and illegal immigrants.

Farmers Branch has become the site of protests and angry confrontations, and opponents of the regulation gathered enough signatures to force the city to put the measure on the municipal election ballot.

The owner and/or property manager shall require as a prerequisite to entering into any lease or rental arrangement, including any lease or rental renewals or extensions, the submission of evidence of citizenship or eligible immigration status for each tenant family consistent with subsection (3).

(3) Evidence of citizenship or eligible immigration status.

Each family member, regardless of age, must submit the following evidence to the owner and/or property manager.

i. For U.S. citizens or U.S. nationals, the evidence consists of a signed declaration of U.S. citizenship or U.S. nationality. The verification of the declaration shall be confirmed by requiring presentation of a United States passport or other appropriate documentation in a form designated by the Immigration and Customs Enforcement Department (?ICE?) as acceptable evidence of citizneship status.


You need a passport OR some paper signed by Immigration and Customs to rent an apartment?

You got either one?

If i needed that in Canada, I wouldn't, unless I applied.

And then I'd have to wait a few months to get them.

Just a birth certificate wouldn't cut it.


The landlord could pay a fine for accepting a birth certificate.

Just hope this doesn't catch on Atlanta could be next.

Why wouldn't a Birth Certificate be acceptable evidence? I am certain it would be. It is proof of citizenship in almost every case.

You can get a passport in the States in a couple of days if it's urgently needed.

For just about any purpose in the US a birth certificate is sufficient to prove citizenship for a citizen born here. It's what they ask for. Ive been asked for my birth certificate a number of times. I've seldom been asked for a passport.The fact that it is not specifically on your list is completely irrelevant.

What do you imagine they mean?

You need a birth certificate to apply for a passport, but you don't get one until they check you out.

Birth certificates are a "dime a dozen" cheaper than driver licenses.

FB site doesn't say what Immigration and Customs accepts.

U.S. passports are issued by the Department of State, not Immigration and Customs.
BTW, for a passport the birth certificate must be a certified copy.

The charge varies by state but is not exactly a "dime a dozen". The last time I got one cost me $12 each for a certified copy. Cost me $36 for 3 copies.

Could I just walk into YOUR country uninvited and get a job or apartment or driver's license without having the proper papers and obeying the laws? I KNOW I could not do that in Jonah's country. Sure as hell can't do that in Mexico either.

So why should the US be criticized for having the same kinds of standards and restrictions?

The article states that either a passport or other documents that are accepted by Immigration will be accepatble... the line in question does not state that Immigration needs to send out some sort of waiver or letter on your behalf.
Since most Federal Agencies accept Birth Certificates, SS cards, and other documents as proof of citizenship, someone would pretty much have to make an effort to not have one of these documents. Unless they're here illegally, that is.
