Advanced Internet Technologies, engaged in a long-running lawsuit against Dell concerning computer quality, has accused the PC maker of withholding evidence in the case.
According to a report in the New York Times, AIT accused Dell of violating a federal court order to produce documents written by its executives in the case. The filing Thursday argues that Dell must have had more high-level communications than it's revealed so far through the legal discovery process, given that the quality problem involved led to a $300 million charge Dell took to handle bulging capacitors on some PC motherboards, the Times said.
A Dell representative told the Times that the company disagrees with AIT's contention and will be filing its response soon. The case is in the U.S. District Court for the Eastern District of North Carolina.
The representative also said Dell replaced 22 percent of the motherboards in its business-oriented Optiplex computers shipped between 2003 and 2005.
