I think that you miss the real response to SCO's allegations. While Linus and company have advocated coding over patent research, that has little to do with the Linux response to SCO. Indeed, the open-source community has said, time and time again: "Show us the proof, and we will change it." Ignorance is an excuse here, because the "pilfered" source is supposed to be hidden.
The Linux community has acted in great faith in trying to avoid the proprietary problem; SCO is instead seeking profit. Any judge will see the heavy-handedness of SCO's action in the face of opponent willingness.
