The Beatles aren't the only musicians going after Apple Computer. Eminem also has a legal battle against the Mac maker, saying the company used his song "Lose Yourself" without permission as part of an iPod ad.

But apparently the two sides are still trying to work things out. Lawyers for Eminem's record label, Apple and co-defendant MTV have asked for a delay in the trial schedule to allow further talks, according to a Detroit News report. In February, Eminem's publisher, Eight Mile Style, sued Apple, its ad agency, MTV and MTV parent Viacom.

A federal judge ruled in May that the lawsuit could go forward, shooting down a motion to throw out the case.

According to the newspaper report, part of Apple's defense is that it only ran the commercial twice. Hmmm...
