An analyst from Morgan Stanley asserts that Apple would sell more iPhones if it offered the phone on more carriers. Really? Wow. We also have an example of a church leader misusing the prefix "cyber." But that's not as crazy as IBM taking on Google. Or is it?

Hi Folks
I thought I’d share this example of Apple’s ever-reaching IP protection policies. Just as background, Woolworths is Australia’s largest retailer (80% of supermarket business goes through two companies here) and they have interests in electronics, hardware and liquor. This news made front page! I recall Fake Steve Jobs writing that Microsoft is like the Borg. I guess this suggests that perhaps Apple isn’t too far different.

Hey guys, in regards to episode #1076 and the rant about the ‘cyber-’ prefix, I just wanted to throw this in. I’m LDS , and as I was listening to General Conference today (when the church leaders speak and church members worldwide tune in via TV, internet, radio, and satellite broadcasts), one of the speakers (they are almost all older men) mentioned ‘cybertechnology’. I thought ‘what??’
Anyway, I love ya, keep it going.

Buzz Crew,
Great show!
You read an email on your October 1 show from James the Field Engineer about Star Trek Props. I worked in pumps/irrigation sales for a couple of years, and found that Infiltrator (http://www.infiltratorsystems.com/productline/h20_chambers.asp) -brand effluent-irrigation chambers are used very, very heavily in TNG, DS9 and Voyager series. They are used as wall support structures and decorations on walls in many diverse sets. As a guy who worked with the stuff every day, it became very distracting to see it in reruns. But it was clever, I’ll give ‘em that.
Also, in about every third episode, an away team would land on a planet, and in the settlement on that planet would be the same, identical trussed lighting-support structure (like for stadium lights, just lighter duty) right in the middle of the village. It would always go up past the camera frame and, presumably, be holding the set lights. But they made it look like it was the aliens’ normal technology. For every alien culture ever.
You won’t possibly care about this enough to read it on air, but Tom might get a kick out of it if he recognizes the Infiltrator linked stuff in various sizes on old STTNG reruns.

Ok, but just to be clear, when I say it's time for me to get a pimp, what I MEAN is that it's time to get a PMP -- a portable media player. That is, perhaps, an iPod Touch. Anyway, you'll understand. In other news, the MPAA is trying to clamp down on your analog hole and break your DVR all at the same time and Apple's Snow Leopard is having a rough landing ... apparently because of the picture on the box.

Buzz crew,
I believe everything you mentioned on Wednesday’s show about what you need to make a phone into a decent in-car GPS is already available, at least for some phones. I have been using TomTom software on a Windows Mobile phone for a couple of years. It does not require live data, you can use the phone AND still navigate (with a bluetooth headset). It sounded like in your discussion you were thinking of only how the Iphone does it. Perhaps a broader look is in order. ( I sound like such a Windows Mobile fanboy, don’t I?)

It appears that Rafe’s statement is true in general, but check out the
wording in the Vehicle Code:
http://dmv.ca.gov/pubs/vctop/d12/vc26708.htm
This part says “Don’t put stuff on your windshield”:
“26708. (a) (1) ( )1 A person shall not drive any motor vehicle with
any object or material placed, displayed, installed, affixed, or applied
upon the windshield or side or rear windows.”
This part says “Okay, MAYBE put it on your windshield, but only if it’s
a GPS thing and only in a certain area”:
“(12) A portable Global Positioning System (GPS), which may be mounted
in a 7-inch square in the lower corner of the windshield farthest
removed from the driver or in a 5-inch square in the lower corner of the
windshield nearest to the driver, if the system is used only for
door-to-door navigation while the motor vehicle is being operated and
outside of an airbag deployment zone.”
So yeah, you can use it on your windshield if you follow those
guidelines.

Heys guys,
In episode 1044, you guys talked about the new PS3 slim. But for owners of the 1st and 2nd gen PS3, there is more reason to hold on to their chunkier PS3s. Even those looking to buy a new PS3, if you can, get the 1st or 2nd gen models. Here’s why:
The older models have 4, instead of just 2 USB ports. They even have SACD and built-in flash card readers, something the slim lacks. But most importantly they have either the Emotion Engine or Software Emulation to play PS2 discs, something new PS3 models like the slim can’t do. Also, the option to install Linux has been removed. And there’s just something about having a large shiny imposing PS3 that you simply can’t get with the smaller PS3.
The slim is more energy efficient though and you do get HDMI-CEC Bravia sync.

Hey ballers,
You want cheap windows 7? How about free? For all you students out there, many universities are signed up with MSDN Academic Alliance (http://www.msdnaa.net/search/schoolsearch.aspx) – this is a repository of microsoft software, including the windows 7 RTM, which you can get for nothing. I think whatever currency you convert that into, it’s going to stay pretty cheap. (You can also gain access to this by buying an IEEE membership, which is only $15.)
It’s a pretty sweet deal, and most people who have access to it have no idea it exists.

I'm OK guys, and today angry, no not they way you might think, I'm angry on the company I love the most and I have spent thousand of dollars buying their products, and loving them, yes, I'm talking to you Nokia.
As you can see on the article below Nokia has sold a monitoring application to Iran's Telecom, for monitoring calls, sms, mms, and internet usage.
http://www.mobile-review.com/fullnews/main/index_eng.shtml#24832
I have read in some other articles that Nokia has said we sold that application on late 2008 and the agreement says it can be used for limited number of users, mostly for security reasons like tracking and finding spy or anything like that, but the Iranian government is using it to monitor everyone's phone, and this is against Nokia's agreement and term of use and Nokia is going to sue Iran's government.
But who knows?
Have a great day
Best Regards

Hey Buzz Crew,
On episode 945 you guys talked about taking breaks for internet at work and about how productive that might be. I laughed when Tom mentioned people working in a call center. I work in a large call center and most of our supervisors do not mind if we take a few minutes here or there to check well known sites such as CNN.com or other related news sites. They do not allow us to surf sites such as Twitter or Facebook because of security risks. I just thought I'd pass that along.

Hi Buzz crew.
I just finished listening to episode 948 where you followed up on the variable pricing from iTunes, Amazon etc. My first reaction was that, since I’m in Canada, my songs will still be 99 cents for a while longer. Nope. I just checked and, sure enough, all songs are now .69, .99 and 1.29 per song. Amazing! It took us over a year to get the iTunes store in Canada after it was launched in the US because of Licensing issues. Just as long to get T.V. shows and movie rentals for the same reason. We couldn’t get the iPhone untill the 2nd generation and when I checked over the weekend most of my purchased music still was not availible for the DRM free upgrade. But raise the price by 30 cents so the record labels can make more money and the Canadian music industry is instantly all over it. Capitalism. Gotta love it.
Speaking of love it. Love the show….Tom, your segues are rubbing off on me.

Yesterday you had a caller mention that Mutant Chronicles was on Video on Demand before theaters. Here is a second movie that I know is going to debut on VOD before hitting theaters. The movie is called Surveillance. It is directed by Jennifer Lynch and produced by David Lynch, two well known directors. It will be on VOD on May 29th and in theaters on June 6.
I am excited about this and I hope this trend continues. Also the new tv series Southland premiered on Hulu a week before it was broadcast on tv.
Here is the link to the surveillance site where it shows the dates of release and a trailer, pretty cool.

Hey guys,
As stupid as it sounds, I know of at least two reasons why someone would downgrade from Vista or even Windows 7 to XP (not that they’re great reasons). First reason–I work for a company that edits patents for the government; and even though we’re a division of a major publishing company and can probably afford to upgrade our software, we have to use the programs that the government mandates, and some of these programs still rely on a command-line interface (apparently the government doesn’t trust us to make tables using a GUI-based program). Given how many bugs are in these programs anyway (and every time they tweak it things go wrong, like we can’t print in bold or something), I don’t think they’re working to update it and make it compatable with anything beyond XP. We’ve tried to convince our contracter (the USPTO) to let us use newer programs, but it’s no-go, so we’re stuck using XP for the forseeable future (and I do mean future).
The second reason? Just today my parents called to ask me if they can downgrade their brand new computer to XP because their old copies of programs like Lotus 1-2-3 aren’t compatable with Vista. Yeah, there are alternatives, but my stepfather is 85 still reminisces about punch cards (he worked for IBM until the mid-80s). I’m still trying to talk them out of it.
Anyway, those are two (annoying) reasons.

Hey Tom, I just wanted to let you know that I actually went to Best Buy about a month ago to buy a dial-up modem. As I recall there was only one type of modem to choose. I had a friend that needed to replace his dial-up modem because it was fried when lightning struck his house. I talked to him about switching to high speed access but in the end he decided to stay with his existing dial up service.

Team RUSH 27 update — Hey guys,
Thank you SO much for reading my email. It was cool to get some props for the stuff we do from you guys.
Anyways, an update. After 2 district competitions (Kettering and Lansing) we are now competing at the Michigan State tournament in Ypsilanti in a little over a week. We have won the Chairman’s Award (the highest award you can win) at the District level, and now we are going on to compete for it at the state level.
GO TEAM RUSH! (You don’t need to fake enthusiasm for this one)
Love the show,

It just warms the cockles to discuss accounting! Time value of money is my real forte, but Apple’s accounting policies are fun too.
I fell several days behind due to a multi-day Battlestar Galactica Season 4.5 marathon. I was quite surprised that we still haven’t arrived at the reason for Apple’s “SOX” issue by the time I caught back up.
As Doug the CPA pointed out, it really isn’t a SOX issue, but SOX means companies pay more attention to GAAP because now all the CEOs and CFOs can get in huge trouble if they don’t follow or have good accounting practices.
So why is Apple doing this? I have no inside knowledge, but the issue is revenue recognition when you deliver a product/service in multiple pieces over time. When you have a subscription based business, it’s easy to tie something like major software upgrades to the ongoing payments customers make. But when you deliver major functionality over time to a device that was paid for all at once some time in the past, you must assess how much of the revenue is recognized at the time of the initial sale and how much of the revenue must be deferred to the time of the upgrade. There are many tests that accountants must apply to the situation. To give you an idea, here is a recent abstract from FASB (Financial Accounting Standards Board) about Revenue Arrangements with Multiple Deliverables (warning, geek accounting content!):
http://72.3.243.42/pdf/abs08-1.pdf
You have to divvy up all of the revenues you receive over the entire time that you are delivering the product. If you add functionality to a product, then you can be considered to still be delivering that product. Apple is being conservative, as many companies do not consider firmware upgrades to be “still delivering the product.” But their conservative approach isn’t completely unreasonable. Apple could choose to defer recognizing revenue from the initial sale, but that would be messier to account for and would decrease the revenue they got to recognize immediately when an iPod Touch is sold.
I guess you could say Apple gets to have their cake and eat it too

Hey JaToNa,
In episode 913, you talked about how Hulu content is no longer available on TV.com. Well, it apparently doesn’t end there because now Hulu is going to be removed from Boxee by the end of the week. Just when you thought that the media companies were FINALLY starting to embrace (using the term “embrace” loosely) the Internet as a new medium for content delivery, the content providers decide to pick up their ball and go home.
I bought an Apple TV in the first place with the specific intention of watching Hulu ON MY TV (thanks to a certain CNet video from Tom)! And while I know there are other ways I can get Hulu on my TV (a netbook comes in handy for this), there was no better or easier way to than using Boxee on an Apple TV. Heck, I even convinced a few of my friends to buy an Apple TV strictly on a demo of Hulu running on Boxee. I now feel bad for convincing them to get an Apple TV given that they won’t be able to get Hulu anymore.
As for the fate of my Apple TV, I’ll still use it to watch my handbraked movies (legally bought) and to watch my video podcasts (especially Loaded). However, it just doesn’t feel the same as before, similar to when that childhood friend moves to another state. Yeah, you say you’re going to write and keep it touch, but you never do…

Dear JaNoTo;
The problem with most of the medical wiki’s is that people don’t do the full
research to properly diagnose their conditions (IMHO over 90% of medical
problems can be diagosed by a good history & physical without all the fancy
tests) and they come to snap decisions. This is especially important when,
like everyone, someone want’s to find a simple, benign diagnosis for their
and can miss subtle finding pointing to a more serious condition and
lifesaving treatments are delayed. I LOVE it when patients come into my
office informed and are able to ask appropriate questions but have a hard
time when they come in and quote the “Insert name of popular pulp magazine
here (name withheld to prevent litigation)” saying “But they said that
pressure on the chest isn’t heart disease but acid reflux so just give me my
antiacids and I don’t need an EKG”.

I was sitting in a waiting room recently and was bored, so I decided to pick up a magazine that was laying around. That is when it hit me that in 5 to 10 years from now there might not be any magazines/newspapers in waiting rooms anymore. If everything goes online what will we do to pass the time in a waiting room? I guess we will either need to remeber our Kindle or maybe waiting rooms in the future will have Kindles just laying around tethered to a desk that people can read while waiting.
P.S. On another note, I read my first version of PC Magazine online since they stopped producing paper copies and it just was not the same. My 1 year old kept wanting to touch the keyboard. It was so much easier with a paper copy that I could carry around and the kindle is to expensive for just one magazine.

I’ve stridently resisted Twitter, but in ep 911 you discussed how disaster news might hit Twitter before professional news networks can release it. My mom was in that recent ice-storm mess in KY and for 5 days I didn’t know where she was or if she was alive. No land lines, no cell reception, no power, no email at home or work, regional/national news too vague. Through Twitter I might have been able to track down news about her neighborhood, or even someone who knew her and could check on her for me. I’m sold. Thanks.

Hey Jaytona,
I don’t think you guys have mentioned this service yet, but just in case… Have you heard of Jinni, http://www.jinni.com? Lifehacker described it as Pandora for movies. Type what you’re in the mood to see and it gives you a whole host of results based on your initial preferences. Last night, my husband and I wanted to watch something with love, friendship and sci-fi (hey it was Valentine’s Day). It came up with Sliders, Wall-E, Starship Troopers, and Highlander to name a few. If you want to watch a movie, it links you to Amazon, Netflix, Blockbuster and other services. Now if only Audible would come up with a similar recommendation engine.
And uh, Sliders was surprisingly good.

Hey Buzz,
I’ve been catching up on BOL after living in a technological black hole for three weeks for a class for work. And when I say black hole, I’m not kidding. This was an Air Force class and we didn’t even have Internet access. I heard you talking about the Airborne Laser program on 29 Jan and thought I would throw in an interesting tidbit. One of my buddies who was in the class with me works on the ABL and told me that it should more appropriately be Airborne Lasers. The system sends out a laser microburst for range and then fires the actual laser using the atmosphere as a lens to more accurately focus the offensive laser. The first burst, calculations, and physical lens calibration all happens within 1/10,000th of a second. The program is still in a prototype phase, but this year they are supposed to deliver a working capability. This would mark a huge advancement as the military will be able to use this technology to make all over-the-air data transmissions more efficient by continuously recalculating the focal strength needed to make up for the losses from a changing atmosphere.
Love the show!

phone running on the OS. It’s going to be called the QiGi i6. Pricing
hasn’t been announced yet but the touch screen looks every bit as
responsive as the G1. However, in these troubled economic times [drink]
they did have to cut a major part of the phone’s design out: the
keypad. As Android doesn’t natively have an onscreen keyboard this
seems like a fairly big omission because when you buy it you’ll have no
way of making any sort of text input like URLs, text messages,
