FTC opposes Motorola injunction request against Apple products

The Federal Trade Commission is lending its support to Apple, arguing that Motorola's attempts to ban the sale of iPads and iPhones allegedly infringing on Motorola patents in a now-dismissed case "risks harming competition, innovation, and consumers."

The U.S. trade agency made the arguments in an amicus brief (PDF) filed today with the U.S. Federal Circuit Court of Appeals, explaining that owners of standard-essential patents (SEP) use the threat of injunctions to demand higher royalties and other favorable licensing terms that owners would not likely have been able to negotiate before the patent was declared … Read more

Appeals court nixes a Galaxy Nexus ban requested by Apple

Samsung got a much-needed break from the courts today, as an appellate court overturned a sales ban on its Galaxy Nexus phone.

Today's ruling from the U.S. Court of Appeals for the Federal Circuit found that the district court in California "abused its discretion" in imposing a preliminary injunction on Galaxy Nexus sales.

The appeals court decision means that the case will go back to the court in California to be reheard, according to Reuters.

The appeals court found several flaws in Apple's arguments for a Nexus ban.

In a new ruling, the United States Court of Appeals for the Federal Circuit says a lower court judge should make a determination on whether to dissolve a U.S. sales ban affecting Samsung's Galaxy Tab 10.1 tablet.

Samsung's once-flagship device was given a preliminary sales ban in June, with stipulation that it could be reversed if Samsung was cleared of infringing Apple's D'889 tablet design patent. Samsung files injunction against LG for leaks, report says

Samsung has filed an injunction against LG, its main rival in the television and display technology sector, over technology leaks, the Yonhap News Agency reports.

Samsung Mobile Display, an subsidiary affiliate of Samsung, submitted documents to the Seoul Central District Court against LG Display, about 18 "confidential technologies" for OLED screens and 21 other details, the news agency reports. 

The court documents seek compensation of 1 billion won ($880,500) where each leak was passed on to a third party or where LG used the technologies, citing sources familiar with the matter.

Apple: Expand the ban on Samsung's Galaxy Tab

In a filing earlier today, picked up by Bloomberg, Apple said it wants to extend an earlier injunction on Samsung's Wi-Fi-only 10.1-inch Galaxy Tab 10.1 tablet to encompass the cellular version as well.

Apple cites the jury verdict from last week, which found the Wi-Fi version of that tablet to infringe on three of Apple's "feature" (i.e., software) patents. The 4G version of the tablet was also on the verdict form, but the jury didn't find that it infringed any of Apple's design (i.e., hardware) patents. … Read more

Apple won the patent case against Samsung late Friday, but the battle between the two biggest smartphone makers is not over yet. The jury in San Jose, Cali. found Samsung products infringed on Apple's patents, such as rounded edges and pinch-to-zoom. The jury decided that Samsung should pay $1.05 billion to Apple in damages.

Sales ban on Samsung's tablet remains in U.S. until trial

Samsung's latest effort to get the U.S. sales ban of its Galaxy Tab 10.1 lifted was derailed today.

In a court order (PDF), the U.S. Court of Appeals for the Federal Circuit denied Samsung's request to suspend a preliminary injunction on its tablet that rival Apple won against it last month.

As intellectual property tracking blog FOSS Patents points out, this decision was coupled with another rejection (PDF) of Samsung's request to expedite an appeal on the matter.

Judge rejects Samsung bid to lift Galaxy Nexus sales ban

A federal judge today denied a Samsung request to lift a ban on U.S. sales of its Galaxy Nexus smartphone.

U.S. District Court Judge Lucy Koh, who last week granted Apple's request for the preliminary injunction, said there was insufficient evidence to stay the injunction for the duration of a Samsung appeal.
