Court drops class-action status of Google digital book suit

A federal appeals court has decided that the lawsuit against Google's digital scanning of books shouldn't be classified as class-action suit just yet.

The 2nd Circuit Court of Appeals said in New York on Monday that Circuit Judge Denny Chin should not have certified a class-action suit against Google, Reuters is reporting. By classifying the case as class action, the judge effectively allowed hundreds of thousands of authors to possibly net some cash in the ongoing lawsuit against the search giant.

Google reaches agreement with French authors

Google and a French authors group have reached an agreement, which means the country will be able to start selling electronic books, the New York Times reported today.

The agreement between Google and the Society of Men of Letters of France includes Google setting up a framework agreement that would allow publishers to offer digital versions of their works for Google to sell. This means France is the only country with an industry wide book-scanning agreement in place to cover works that are out of print but still under copyright, an issue that continues to plague U.S. authors.

The Authors Guild is ready to take on Google Books after its book-scanning lawsuit "cleared a major hurdle," Authors Guild President Scott Turow wrote in a blog post published today.

A judge filed a ruling today that gives authors, photographers, and illustrators the green light to sue Google.

The ruling allows the drawn-out court case -- over Google Books' practice of scanning book out of print and copyrighted content for Web searches -- to move forward. The suit will now determine if Google's argument that it has a fair-use defense has any merit.
