Samsung says it will drag iPhone 5 into legal war

It appears that Apple's iPhone 5 isn't going to escape the ongoing legal battle with Samsung Electronics.

Samsung said it would add the recently unveiled smartphone -- which has already seen record pre-sale figures and which will hit stores tomorrow -- to a list of products accused of violating its patents, according to Reuters, citing U.S. court documents.

Samsung confirmed to CNET that it would pursue the iPhone 5.

Based on information currently available, Samsung expects that the iPhone 5 will infringe the asserted Samsung patents-in-suit in the same way as the other accused iPhone models. Samsung … Read more

Judge won't dissolve U.S. Samsung tablet injunction -- yet

Samsung's efforts to dissolve a 3-month-old ban on its once-flagship tablet have been put on ice by a U.S. District Court judge.

In an order this evening, Judge Lucy Koh -- who has presided over the San Jose, Calif., trial between Apple and Samsung -- denied Samsung's motion to get a June sales ban on its tablet reversed.

At least for now.

Judge Koh cited a lack of jurisdiction, something the court needs to wait on a mandate from the Federal Circuit to restore. With that said, Judge Koh said that the motion itself brought up a &… Read more

Samsung's image doing just fine after Apple verdict, poll finds

While it's easy to look at the overwhelmingly pro-Apple verdict handed down by a San Jose, Calif. jury last month as damaging to Samsung's image, a new survey suggests that's not the case.

According to the results of a new survey put out by polling firm YouGov, Samsung has had a big comeback in the past two weeks, and actually managed to surpass Apple in the firm's proprietary "buzz score" rating among both early technology adopters and those in the 18-34 age group.

The methodology behind the numbers asks people if they have "… Read more

Korea investigating Samsung over Apple antitrust claims

South Korea's competition watchdog is launching an investigation into Samsung's practices.

The country's Fair Trade Commission today announced that it would investigate the ways in which Samsung is using its wireless technology patents to address competition in the marketplace. Reuters, first to report the news, said an FTC official claimed Apple filed the complaints against Samsung earlier this year, arguing that Samsung is using its patents to hurt competition.

There is certainly no love lost between Apple and Samsung. The companies are waging patent disputes worldwide, and last month Apple won a major victory in San Jose, … Read more

Apple loses Samsung patent infringement lawsuit in Japan

While Apple has scored a big patent judgment on its home turf, it hasn't been so fortunate overseas.

After winning a lopsided $1 billion damages award against Samsung last week from a jury in the U.S., Apple lost a case Friday in Japan when a Tokyo judge ruled that its South Korean rival's smartphones and tablet computers don't infringe on the iPhone maker's patents, the latest legal decision in the international struggle between the two companies over intellectual property.

Specifically, Tokyo District Judge Tamotsu Shoji found Samsung did not infringe on patents related to synchronizing … Read more

Court filing provides peek at Apple's massive legal bill

Just how much did both Apple and Samsung spend in their massive U.S. trial against each other? A new filing provides just a peek at Apple's going rates, and spoiler alert: it's a chunk of change.

As part of a procedural filing about how much Apple's law firm in the case, Morrison & Foerster, spent working on just a single motion requesting sanctions against Samsung, the firm detailed what 10 of its staff did by task. That includes hours worked, and how much everyone was paid for that time.

All told, the bill for just that … Read more

Memento for patent jurors: 42 articles they missed during trial

British author Douglas Adams joked in his seminal work "The Hitchhikers Guide to the Galaxy" that "the answer to life, the universe, and everything" was 42. It turns out that's the same answer the court in the Apple v. Samsung trial arrived at when considering the satisfactory number of news stories to give the formerly sequestered jury members once the trial wrapped up.

The request for such a collection came from U.S. District Court Judge Lucy Koh after one juror mentioned having seen just a headline about the trial on the very first day. … Read more

Samsung, carriers to modify infringing devices, report says

Samsung is working to modify its products to ensure they don't get caught up in an injunction, a new report claims.

The Korea Times reported yesterday, citing sources, that it spoke with Samsung officials who said that the company is in talks with U.S. carriers, including Verizon Wireless, to determine the best way to modify designs across its Galaxy line. The products it plans to modify were cited as infringing in last week's landmark patent loss to Apple.

According to the Korea Times' source, Samsung and carriers will "jointly develop modified design technology," though the … Read more

HTC has 'no intention' to settle with Apple, say reports

HTC's chairperson said that the company has no intention of settling with Apple, according to Asia-based reports.

The report appeared in Wednesday's Digitimes and other Asia-based publications, which cite comments from Cher Wang, chairperson of HTC.

HTC "has great skills in innovation and has the confidence to face legal lawsuits with Apple," the Digitimes report says, attributing those comments to Wang.

She also said that the $1 billion jury verdict against Samsung in the U.S. "does not mean the failure of the entire Google Android ecosystem."

HTC has been mired in a legal … Read more

Apple injunction hearing against Samsung phones set for Dec. 6

The next phase of the Apple-Samsung patent infringement saga has been scheduled for December 6.

That is the date on which Lucy Koh, the presiding judge in the closely-watched trial, will hear Apple's motion for an injunction against eight Samsung mobile phones, as well as the South Korean electronics giant's expected motion to have the jury's verdict set aside.

"Having considered the scope of Apple's preliminary injunction request, the additional post-trial motions that the parties have already filed and will file, and the substantial overlap between the analysis required for Apple's preliminary injunction motion … Read more
