Apple v. Samsung: Tech firms want trade secrets protected

Some of the largest tech firms want the country's court system to hush up when it comes to their trade secrets.

Apple, Samsung, Intel, and Qualcomm are fighting to keep their trade secrets from spilling out into public view as part of the Apple v. Samsung patent trial.

The most recent example came this afternoon when Qualcomm filed papers opposing attempts by Reuters news service to unseal documents in the case, including details about licensing agreements Qualcomm entered with at least one of the litigants. Earlier, Samsung lawyers tried to get an Apple executive to open up about the unreleased iPhone 5. … Read more

Apple's iOS chief recalls iPhone's 'Fight Club' beginnings

SAN JOSE, Calif. -- After explaining to the court how it designed and marketed the first iPhone and iPad, Apple today brought out the architect behind the software, who re-told the device's secretive beginnings.

That includes locking down an entire building at the company's Cupertino, Calif. headquarters, and taking it over floor by floor to begin work on the top secret project.

While Apple's secrecy is well-known, Scott Forstall described just how extensive it got in the beginnings of the iPhone project. Extra security points were added, including more badge scanners, cameras, and cheeky signage on doors … Read more

Samsung tries to get Apple to talk iPhone 5

SAN JOSE, Calif. -- There's been no shortage of once-confidential Apple information spilling out recently, ahead of the Apple v. Samsung patent trial here. But with the proceedings in full swing, today could have brought the biggest revelation of all.

During the cross-examination of Apple marketing chief Phil Schiller, Samsung's attorney tried to get the executive to talk about a product that hasn't been announced yet.

In an attempt to get Schiller talking about design, Samsung attorney William Price asked Schiller whether Apple's next iPhone model would look anything like existing versions, or if changes were … Read more

Apple's Schiller talks iPhone, iPad birth -- and gambling

SAN JOSE, Calif. -- To help tell the story of how it came up with the iPhone and the iPad, Apple enlisted the same man it uses to sell the products to potential customers.

Apple's marketing chief, Phil Schiller, who is a frequent face at the company's product launches, retold the creation story of the iPhone and the iPad -- a slightly expanded version of the tale jurors heard during the company's opening statements earlier this week. He also gave the world a glimpse of a secret portion of Apple's marketing strategy -- how much it … Read more

Apple lawyers: Watch Samsung handsets morph into iPhone

Apple has just released several exhibits that it plans to enter into evidence that allegedly show the evolution of Samsung's handsets before and after the launch of the iPhone.

Arguments in the patent case between Apple and Samsung were due to start again at 9 a.m. PT. Apple's lawyers are expected to hammer away at Samsung's contention that it was working on similar technology offered in the iPhone prior to 2007 when the iPhone was launched.

Apple's exhibits seem to show, however, that Samsung's phones didn't start taking on the same look and … Read more

Apple v. Samsung re-opens with plenty of drama

SAN JOSE, Calif. -- Nearly half an hour before the jury even stepped into the room, tension was in the air.

Both Apple and Samsung, who are in the beginning phases of a month-long patent trial here, were awaiting a decision on what U.S. District Judge Lucy Koh would do about a spat between the two companies stemming from excluded evidence Samsung sent out to press. Apple had drawn concern about the issue, saying it might taint the jury.

Koh put that to rest this morning. She dismissed Apple's request to punish Samsung's attorneys and instead brought … Read more

Apple to Samsung: Don't reveal iPad, iPhone sales data

Apple has asked a U.S. District judge to prevent Samsung from making public "confidential" and "competitively sensitive" information today during court proceedings.

In documents filed by Apple, the company's lawyers said they have two separate motions to seal the information pending before the court and that they make a "document-by-document showing of good cause and compelling reasons for sealing" the exhibits that Samsung wishes to use when it cross-examines Philip Schiller, Apple's senior vice president of worldwide marketing.

Apple filed a patent suit accusing Samsung of ripping off its intellectual property … Read more

Samsung lashes back at Apple in excluded evidence spat

As expected, Samsung has fired back at Apple's efforts for legal sanctions against it in the federal case between the two companies.

In a new filing this evening, Samsung once again said it only sent out excluded trial evidence to members of the media because it had received requests from them for more information, and that said information had already been made public in earlier filings.

Samsung then pointed fingers back at the court for requiring that information to be public in the first place.

"In the days and weeks leading up to jury selection and Samsung's … Read more

Apple: Misconduct part of Samsung's legal strategy

Apple railed against Samsung's conduct in a court filing response seeking sanctions against Samsung for releasing excluded evidence to reporters as the legal drama between the two technology giants continues to unfold.

"Litigation misconduct is apparently a part of Samsung's litigation strategy -- and limited sanctions have not deterred Samsung from such conduct," Apple said in its filing to Judge Luck Koh and the U.S. District Court in San Jose.

Apple, curiously, isn't seeking a mistrial, which it argues would benefit Samsung, or even a fee. Instead, it asked that the court grant Apple … Read more
