Samsung keeps prior art parade marching against Apple

SAN JOSE, Calif. -- Samsung today brought out early technology relics in hopes of busting Apple's design patents for the iPhone and iPad -- the very ones Apple has pointed at it like howitzers.

The South Korean technology giant called upon a pair of experts -- one in person, another by video deposition -- to make the case that others had beaten Apple to the punch, effectively rendering those patents useless.

Samsung's argument relied mainly on foreign patent designs and an early prototype for a tablet that never made it into commercial production. However, Samsung also brought out … Read more

Apple v. Samsung: Judge Koh loses cool over legal wrangling

U.S. District Judge Lucy Koh has had her fill of courtroom "theatrics" and questionable legal maneuvering from both sides in the Apple v. Samsung patent trial.

"I want papers," Koh told the court on Tuesday after Apple objected to one of Samsung's witnesses. "I don't trust what any lawyer tells me in this courtroom. I want to see actual papers."

Koh was obviously frustrated when Apple and Intel tried to block Tim Williams, Ph.D., one of Samsung's expert witnesses from testifying. Apple said Williams had not properly disclosed that … Read more

Top Samsung designer: We didn't copy Apple

SAN JOSE, Calif. -- In an effort to rebut allegations that it copied the design of Apple's iOS home screen, icons, and other visual features, Samsung brought out one of the people in charge of designing the software in its phones.

Jeeyuen Wang, Samsung's senior designer, testified this afternoon with the help of an interpreter, and flat out told the court that the company did not copy Apple's designs.

Samsung brought out Wang to counter copycat claims made by Apple earlier in the trial that put the Samsung's iconography and features side by side. That offense … Read more

Samsung breaks out the oranges in its offensive against Apple

SAN JOSE, Calif. -- Samsung wove family photos, pieces of fruit, and even a little Bruce Springsteen into its patent offensive against Apple today.

With three Apple feature patents aimed at nearly two dozen of Samsung's products during the past two weeks of trial, Samsung struck back today with a trio of its own.

On the stand for Samsung was Woodward Yang, a patent specialist who went through how some of Apple's iPhone, iPad, and even iPod Touch models allegedly infringed on three of Samsung's patents covering things like e-mail, photo albums, and playing music in the … Read more

Intel tries to get Samsung expert witness booted

SAN JOSE, Calif. -- Intel took offense at one of Samsung's expert witnesses, attempting to get him excluded from the trial between Apple and Samsung here.

Ahead of the testimony of Tim Williams, Ph.D, Apple said Williams had not properly disclosed the fact that he had signed multiple nondisclosure agreements, one of which Intel says prohibits him from discussing the particulars of Intel's source code.

Samsung had called on Williams to discuss Apple's alleged infringement of one of Samsung's cellular data transmission patents, which included citing some of the source code.

An Intel lawyer briefly … Read more

All of Apple's patent claims against Samsung in one chart

SAN JOSE, Calif.-- Even with the number of devices whittled down just a hair, Apple still says more than a dozen of Samsung's smartphones and two of its tablets are infringing on its patents.

That's easy enough to understand, until you get into just how many patents we're talking about, and which ones apply to which device.

To help make sense of it, Apple has included a rather large chart -- OK, it's safe to call it gigantic -- that spells out which device the iPhone and iPad maker believes Samsung is infringing on, and … Read more

iPhone owned 63 percent of smartphone marketshare at AT&T

Apple's share of the smartphone market dominated at AT&T and Verizon, but Samsung's share was growing, records show.

In the first quarter of 2010, Apple owned 60 percent market share compared with Samsung's 3 percent. The combined market share belonging to all the other phone makers equaled 37 percent.

The data was made public as part of Apple v. Samsung, the ongoing patent trial that has enabled tech fans to take a peek at some of each company's trade secrets. Apple filed suit last year and accused Samsung of pilfering the iPhone and iPad'… Read more

Samsung goes on offense, aims to bust Apple patents

SAN JOSE, Calif. -- One of Samsung's main strategies against Apple has been to point to "prior art," pre-existing versions of the features and designs made by others that could potentally invalidate the patents Apple is wielding against it.

In the earlier part of the trial, Samsung focused on patents for phone designs. Today, though, the company got into the guts of Apple's software -- in particular, the gestures people use to control iPhones and iPads.

Samsung brought out a pair of "fact witnesses" -- i.e. not experts -- involved in technology that … Read more

Judge tosses trio of Samsung phones from Apple case

SAN JOSE, Calif. -- Samsung scored a minor victory in court this afternoon when the judge in its patent fight with Apple excluded three of its allegedly infringing phones from the case against the two U.S.-based parts of its business.

U.S. District Court Judge Lucy Koh excluded the Galaxy Ace, Galaxy S i9000, and Galaxy S II i9100 -- all world phones that could be purchased in the U.S., but that weren't sold by Samsung's telecommunications and electronics divisions in the U.S.

The decision, which still leaves Samsung Electronics Company Ltd. (the Korean … Read more

Samsung exec: Don't copy, 'learn the wisdom of the iPhone'

SAN JOSE, Calif.--Despite numerous pieces of evidence suggesting Samsung eyed Apple's software in the creation of its devices, a new internal memo shows that some inside the company warned designers against mimicking the iPhone too slavishly.

Near the tail end of cross examining Terry Musika, the accountant Apple hired to estimate the $2.5 billion damages figure in the case, Samsung brought out an e-mail thread from one of its own top designers, Sungsik Lee.

The e-mail, sent on March 2, 2010, and addressed to the company's "UX [user experience] executives," makes the case that … Read more
