Oracle ordered to name settlement price in SAP lawsuit

A federal court judge ordered Oracle to name its settlement price in its ongoing litigation against archrival SAP over the handling of proprietary maintenance and support information for former Oracle customers who had switched over to a subsidiary of SAP.

Judge Joseph Spero on Monday ordered Oracle to give a specific dollar amount by February 13 to settle the lawsuit it filed in March 2007. Oracle previously indicated in its lawsuit that its damages were in excess of $1 billion.

SAP has until February 18 to issue a counterproposal. A settlement conference is scheduled for February 23.

Oracle amends SAP TomorrowNow suit

Oracle upped the ante in its lawsuit against rival SAP on Monday, claiming in an amended complaint that SAP's CEO and other top executives were aware of alleged illegal downloading of proprietary software and documents before, during, and after its acquisition of third-party support and maintenance company TomorrowNow.

The amended complaint broadens the allegations raised by Oracle in its initial lawsuit in March 2007. SAP may sell TomorrowNow

SAP announced Monday its third-party support and maintenance company TomorrowNow, which is embroiled in a legal battle with archrival Oracle, may be put up for sale. TomorrowNow's founder and several executives have resigned effective immediately.

SAP acquired TomorrowNow as a means to woo away maintenance and support customers from Oracle. TomorrowNow provides third-party support and maintenance for PeopleSoft and JD Edwards, two companies that Oracle acquired.

But earlier this year, Oracle filed a lawsuit against TomorrowNow and SAP, alleging the company went beyond its former customers' contracts and downloaded proprietary Oracle software and materials.

SAP to respond to Oracle complaint by midnight

SAP said it plans to formally respond by midnight (PST) Monday to Oracle's lawsuit, which claims SAP's wholly owned subsidiary TomorrowNow accessed Oracle's proprietary support and maintenance information beyond contractually allowed levels.

SAP, which has already proclaimed it will "aggressively defend itself" against its rival's lawsuit, is expected to offer a more detailed counterpoint to those allegations later today.
