A federal appeals court Wednesday denied broadcaster 21st Century Fox's appeal to make Dish Network Corp.'s Hopper ad-skipping service temporarily unavailable to consumers.
According to an opinion from the U.S. Court of Appeals for the Ninth District, a panel of the court affirmed a lower Los Angeles court's decision denying a preliminary injunction against the feature, agreeing the lower court did right in saying Fox failed to show that its copyright-infringement and breach of contract claims were likely to succeed.

Arriving on Fox and National Geographic channels in spring 2014 as part of a 13-episode series, "Cosmos: A Spacetime Odyssey" builds off Carl Sagan's groundbreaking series of a similar name (subtitled "A Personal Voyage") seen on PBS more than 30 years ago.
The trailer indicates that Fox spared little expense on the effort, as there's an extraordinary amount of high-end special effects and animation seen throughout the tease. In many scenes, deGrasse Tyson appears to control a sexy spaceship that drops in and out of spectacular stars.

Aereo is trying to cut CBS off at the legal pass.
The TV streaming service has filed a complaint against CBS (CNET's parent company), to prevent it from filing yet another lawsuit against it. Aereo allows people to watch and record live network broadcasts via the Web, a feature that has gotten it into trouble with CBS, Fox, ABC, and NBC. The networks have argued that Aereo's $12-per-month service is illegal because it distributes their shows without compensating them in return.

The company took out a full-page ad in the front section of The New York Times on Tuesday, making a case as to why its business isn't breaking copyright law.

Another television network has joined the broadcaster backlash following last week's court decision upholding Internet TV company Aereo's right to stream broadcast TV without paying retransmission fees.

Dish Network is a believer in advertising its Dish Hopper DVR, which allows users to automatically skip ads on recorded programs. The AutoHop feature, as well as the capability to watch programming over the Internet and on mobile devices, are the subject of multiple lawsuits brought by the TV broadcast networks.
