Samsung on peace with Apple: 'The ball's in their court'

SAN JOSE, Calif. -- Near the end of a more than three hour hearing between Apple and Samsung, a California judge once again asked both sides to put an end to the dispute.

"It's time for global peace," U.S. District Court Judge Lucy Koh told both companies, with a sense of exasperation.

"Is there anything the court can do? I'm more than willing to issue orders," she continued. "It would be good for consumers, good for the industry, good for the parties."

"We are willing. The ball's in their … Read more

Samsung tries to fend off zombie phones in Apple verdict fallout

SAN JOSE, Calif. -- Can phones come back from the dead to nibble at your bottom line? If you're Samsung, that's become a very real threat.

The company faces both an injunction on some devices found to infringe on Apple's patents as part of a jury verdict here in August, as well as adjustments to damages on devices it has long since put to pasture.

"They're seeking an injunction on all 29 products, even though Samsung only sells three products," Samsung's attorney argued.

Those three products consist of about 77,000 units of … Read more

Apple, Samsung once again haggle over damages

SAN JOSE, Calif. -- Depending on who you ask, the $1.05 billion in damages awarded to Apple against Samsung was either too much or too little, but both companies today had much to say about some of the details in how that decision was reached.

At the heart of it, there's a disagreement on Samsung's side about how the jury came to decide the damages for the Prevail, one of Samsung's devices that was found to infringe, and made up $57.9 million of the tally. The only problem, Samsung argues, is that the jury was … Read more

Apple, Samsung head back to court for key hearing tomorrow

With a verdict that landed almost entirely in Apple's favor, you'd think we'd be all wrapped up with the trial between Apple and Samsung that concluded in August.

You'd be wrong.

There's still quite a bit up in the air, some of which will be sorted out as the two companies return to a Northern California district court tomorrow afternoon for a hearing.

On the docket are a number of issues that have been the focus of more than 200 court filings since the late August jury verdict, which left Samsung on the hook for $1.05 billion in damages. … Read more

Judge: Patents in Apple-HTC settlement deal can't be sealed

Major details of the legal settlement between Apple and HTC could be made public following a ruling from a California judge.

In an ruling tonight, U.S. District Court Judge Lucy Koh said that while details of pricing and royalty rates for patents from both companies should be kept under wraps from public view, the same does not hold true for the rest of the agreement.

"This Court has repeatedly explained that only the pricing and royalty terms of license agreements may be sealed," Koh wrote in a ruling. "There are compelling reasons to seal pricing and … Read more

Apple denies Samsung's claim that it withheld juror info

Samsung is trying to raise doubts about a $1 billion jury verdict that found the company violated Apple's patents, but some of Samsung's new claims are in dispute.

Samsung alleges that the jury decision in August, which found Samsung had infringed Apple's patents involving the iPhone and iPad, was tainted partly because Velvin Hogan, the foreman, withheld information about a lawsuit he was involved in with Seagate, one of Samsung's partners.

Samsung, which also suggested Apple knew about Hogan's conflict with Seagate and withheld the information, demanded that Apple disclose what it knew. On Friday, … Read more

Apple targets Galaxy Note 2, S3 Mini in latest court request

Apple and Samsung continue to hurl gadgets at each other in their seemingly never-ending patent battle.

Midweek, Samsung filed a request that the iPad Mini, the fourth-generation iPad, and the fifth-generation iPod Touch be included in a California case set to go to trial in 2014. Not to be outdone, Apple responded last night by asking that several more Samsung devices, including the Galaxy Note 2, the Galaxy S3 with Android 4.1, and the Galaxy S3 Mini, be covered by the case.

The last round of tit-for-tat additions to the list of gadgets covered by the case included Apple'… Read more

Samsung claims iPad Mini, latest iPod violate its patents

Samsung charged Wednesday that Apple's iPad Mini, fourth-generation iPad and fifth-generation iPod Touch violate its patents. The company asked a federal district court to add the products to its latest patent fight with the Cupertino, Calif., computer giant.

The Samsung complaint, which we've embedded below, alleges that Apple's latest products infringe the same patent as previous versions of its devices. Samsung essentially claims that "all Apple products including a built-in speaker and an external audio output port" infringe this particular patent, and thus argues that the newest Apple products should be included in the case. … Read more

Judge: Samsung gets to view Apple-HTC settlement details

Samsung will be privy to some details of a confidential settlement agreement between Apple and HTC, a California judge ruled today.

Samsung's lawyers were given the go-ahead to view confidential details of the agreement that made peace between Apple and HTC earlier this month, following an impromptu hearing ordered by Magistrate Judge Singh Grewal this morning.

That deal, announced November 10, put an end to all litigation between the two companies. Many expect the same thing to eventually happen between Apple and Samsung, but recent comments made by officials of the South Korean technology giant suggest even talks about a deal are out of the question. … Read more

Samsung wants details of Apple's settlement with HTC

Samsung is showing its first public interest in the settlement that ended the legal fight between rival Apple and HTC this past week.

Samsung this afternoon filed a request with the court for Apple to provide a copy of its patent license agreement with HTC.

That deal, announced on Saturday, put an end to the bitter battle between the two companies, a conflict that's similar, but smaller in scale to the one between Apple and Samsung.

In its filing, Samsung says it wants to see what patents were covered as part of the agreement since there may be some … Read more
